State Specific Question About: NEW JERSEY (NJ)
Has anyone experience a tenant defaulting on their very first rent payment? What remedy is available? Does this means you got a dead beat tenant when they are nurses who makes money. Experience: No.
Remedy: Eviction, same as any other tenant who doesn't pay rent.
Meaning: a deadbeat tenant who doesn't pay rent.
Tenants who make money: Did they really default? or, did they forget, or can't get organzed to collect among roommates?
Increase security deposit or evict: Your choice. Which will work better for you in the long run?

I am so sorry. Evict now. This won't get better. And yes, I have had it happen to me. My fault, as I had multiple vacancies and allowed myself to be stressed, panic and sloppy screening. She had a good, stable job with sufficient income. When she left, after I evicted her she had quit her job, took my brand new appliances and moved out of state. It was a hard lesson to re-learn. I've had a tenant bounce the first month's rent AND security deposit. That was a scary feeling, but they did end up fixing it. Ever since then, I will ONLY accept certified funds for the first month and security deposit. They can use clearnow after that. --174.226.x.xxx |

I have some that claim they didn't know when or how to pay. It is in the lease and I go over it with them when they move in. But, if they pay up when I remind them, we move forward. I have found nurses are like doctors, not very organized in the financial arena. They have the bucks but forget to transfer the funds or use the wrong account.

You get what you allow.
They know the rent it unpaid and are just waiting for tue late notice. Never assume people have money, even nurses.
Learn what your local judge wants.
Me? The day the rent is late we text ‘Rent is unpaid. This is your 3 day notice to vacate or pay within 3 days to avoid sheriff eviction. Pls reply when paid or out.” 90% pay with just that text.
We file on day 4.
We also offer to put them on PayDayPlanRent (weekly) so they only owe $186 now.
Our late fee is $5 per day.
ZERO TOLERANCE on lates. They are playing you and YOU are losing money.

Thank you all for you professional advice and input. You’re so right. I used a Gut feeling thinking the pair are nurses so they will have no problem paying the rent. Moreover, I did not check or SCREEN them based on the same feelings of their professional occupation. I didn’t even call the hospital where they work, I just saw the incomes and automatically assumed I hit a jackpot of a tenant. What a fool I was relying on a gut feeling or based on their profession. I will never ever do that again. Now I screen and screen and ask all the pertinent questions regarding renting. By the way I have evicted them, but they owe me 3 months of rent. Thanks again for all the valuable info and responses. We LLs must stay a tight community and help each other to combat these professional deadbeat tenants aiming to get free rent on our hardwork and stealing our profits.

How could they have defaulted on the First payment? I never turn keys over until I have security deposit and First months rent.
Now defaulting on the 2nd payment is another story. Unfortunately it does happen. You need to review your screening procedures to see what you can improve upon for the next time.

A phrase I repeat often while making repairs on one of my recently found shacks - it can only get better but I get places where the light switch turns off the fridge outlet or the sink light switch is upside down - a semi-drunk helper once told me that is so when you are trying to find the light and your hand slips it works!
Anyway use the search tool here about screening and not too far back someone alerted us that HUD and fair housing recently will begin to investigate if you instantly deny a applicant based on having a felony alone, you should already have your local and state tenant rules printed before you opened for business and now would be a good time to find a landlord group in your area where you can ask questions about how those laws work in real life owner/manager world. --76.188.xxx.xx |

Before you go to convention read your Landlord Tenant laws for the state of New Jersey. High Lite the areas that don't make sense to you. When you are at the convention talk to other NJ landlords about the laws that does not make sense to you. You may high lite the entire L/T ACT and maybe not. Sometime legal-eze can be confusing and intimidating.
The tenant owns a piece of paper; called a lease. What is the value of that lease after it expires and even before it expires. Zero value after its expires and before it expires. Let a residential tenant take a lease to the bank and try to get a mortgage approval based on that lease. NOT HAPPENING!!!
The Landlord/Owner owns a piece of paper called a DEED and most likely has a mortgage and many other responsibilities with that Deed as the owner of that piece of real estate .
Who's in charge the Landlord NOT the tenant!!! The landlord trains the tenant...
