State Specific Question About: PENNSYLVANIA (PA)

The Borough where I have multiple rental units, newer Town Homes and a few older apartment rentals, requires an inspection done on all rental properties. While they do check for smoke detectors fire extinguishers for safety reasons, they also have a long list of other things that really have become a time consuming ordeal. The amount of paper work involved itself is daunting because it involves both tenants and landlords and coordination between both. Often times these inspected items involve both tenant and landlord responsibilities.

I've head that there are other localities that these are taking place in and am wondering if any have ever been challenged in Court to find out how lawful these are? --72.23.xxx.xxx

It could be argued it's a violation of the 4th Amendment because of unreasonable searches of your Tenant's homes. Do they search the homeowners next door? Maybe it's just Tenant's who get their right to privacy ignored. Are all rental owners treated the same or vare some "special". --216.23.xxx.xx

Gene, I have suggested to our council that they follow this ruling from federal court but they just rename the wheel they are trying to run us over with, I have passed out many fliers at landlord and council meetings, some questions have came from council attendees and I remind them all that this simply raises the cost of housing - chasing away the good people. --76.188.xxx.xx

They do fire inspections here outside of Trenton in NJ and have for years. They do inspections prior to renting to get a Certificate of Occupancy. It costs me $600 for my three buildings to get a license and fire inspection and additional over a hundred to get a CO if someone moves.

They tried to keep college students out of rentals by ordering that no one could park on the street anymore but people got a local former DA to serve as an attorney and sue them and he won thankfully. The local college struck back by building many more dorms and having a little town center so no one has to leave the campus. I figure the politicos didn't want students taking up homes that they could have rented to or owned by people who will reliably vote for them and keep them in office since that's what happens

Were all filthy rich landlords, its called easy money for these towns and boroughs. I've commented the same thing for decades

why is a rental house inspected but Not an owner occupied home. Do the safety items in owner occupied homes somehow never go bad. Most of the owner homes Ive purchased over the years were so outdated in terms of heating, plumbing and electrical that if it was a rental would have failed.

Because in most areas, owner occupied dominates the housing. They dislike rentals so will support local ordinances providing for regulation and inspection of rentals. Of course they don't want anyone snooping around their own house.

This has nothing to do with "govt" or bureaucrats and everything to do with rentals being a minority of the housing stock. Blame these owner occupants for their intense hatred of rental properties --12.47.xx.xxx

I suspect others of us view ourselves much higher on the food chain. nhsailmaker, govt workers are lazy, why would they add all these paperwork and inspection to their workload if they didn't need to? They would also have to get a higher budget approved.

No one who owns their house wants the houses in their neighborhood to be a rental. They are the ones who vote for these policies. "OUR..... govt. The term “big government” stimulates plenty of images and emotions, and they’re always negative. Words like “bureaucratic,” “inefficient,” “intrusive,” and even “corrupt” are always associated with the "Boro Inspection" liberals and democrats.

Small government, on the other hand leads to a more efficient and flexible system. “Getting government off our backs” or “getting government out of the way” are cries to cast off tyranny and empower small businessmen and entrepreneurs. We are the ones that don't allow OUR hired Bureaucrats to smother us with unless "Boro Inspections".

Landlords in the City of Pittsburgh have successfully taken rental inspections to court several times and won. It takes a lot of time and money to fight, the city has enough large landlords to make it worth their while. Even at that the city tries every few years with a different approach requiring the landlords to gather and fight again. Small towns not only 'inspect' by targeting but many also collect fees that exceed the cost of the program which clearly violates state law. It just costs time and money to fight and if you are a small landlord the cost of that fight will exceed the savings to be had --72.95.xxx.xx

NE (PA) Here in NH we also don't have a sales tax - we don't have a income tax - We don't have seat belt laws - we don't have Motorcycle laws. No Gun license to carry concealed. etc etc etc......Heck in many towns we don't even have building inspectors. However ..... You get to CHOOSE to to wear your helmet or seatbelt.
