State Specific Question About: PENNSYLVANIA (PA)

This is for my sister. She is on HUD has been for years, they just told her she has about $1700 worth of back rent from 10 years ago!? Is there some kind of cap? she can't even get bank records after 7 years to prove that she paid, not to mention she has changed banks since then. She was living in housing at the time and received nothing saying she was late on rent or anything for that matter. She's lived 3 different places since then and now all the sudden they realized she owes money?! She is scared to push them and/or take them to court because she is a single mom with no ties (child support $) with the father, so she needs this assistance to keep a roof over their heads. I think 7 years is the max to go back for back rent in Pa.

Tell her to make them prove it.

WMh she said back rent not judgment. I'm not familiar with the term judgment but I'm assuming it would be referring to whether or not she qualifies for HUD and if it would be the same circumstances as assistance then that is don yearly in PA so they should have noticed it before. Just $1700 seems like she would have been evicted or given some kind of notice back then. --98.5.xxx.xxx

I do not understand. I am assuming that HUD was NOT the landlord, but that HUD was subsidizing her rent by making partial rent payments on her behalf to the Landlord.

So, is the situation one where HUD is now claiming that HUD overpaid its share and that she must now reimburse HUD for some of the money that HUD paid to her landlord?

If that is the case, HUD is likely asserting that she understated her income or had the baby-dad living with her without reporting that to HUD or otherwise defrauded HUD, causing HUD to over-contribute.

There would normally be a time limit, but if she is still living on the government's benefits, she might not be in the position to tell HUD to go jump in a lake.

VEE: I don't know about every Fed division but I do know the IRS has a 10 year limit on collections.

I agree that we do not have enough information. If she has been in 3 different locations they absolutely should have discovered this sooner...but it is the government. --71.75.xx.xx

I think Section 8 landlords make a big mistake not going after section 8 tenants for missed rent.

If you get a judgement for unpaid rent or damages and take it to the section 8 office they will make the tenant pay back the money or they will lose their voucher.

That is one of the advantages of renting to section 8, you have someone in the relationship who has the power to make the tenant comply.

I bet your sister got a judgement against her for unpaid rent. Now the HUD office is aware of the judgement. She must pay the money back or she will lose here voucher.

Landlords get judgements against voucher tenants and then go to the sec. 8 office and make them pay. The office will ask if you will accept a payment plan. If they miss a payment you can get them kicked off.

Thanks for the information she is paying it back. Just confused as why it took so long, if she would have known then or sooner she would have handled it then. Sorry for the lack of information but as I said it's for my sister not myself so I don't know every single detail about it, only what she has said and what I have seen for myself. Their is obviously proof of the bank rent but as I said before she can't provide her own proof of payment with it being back in 2008. As for sympathy Nicole no one is asking for that and I didn't imply that we wanted any pitty in my question by any means so I don't know why you even said that? I'm glad that you are doing so well for yourself but unfortunately others have other circumstance in their life and aren't as lucky. --98.5.xxx.xxx

Your sister should request a breakout of the costs and how they were incurred to ensure they are correct. She also shouldn't have to pay any interest, if they are charging any, since it took them so long to present her with a bill. --71.75.xx.xx
