I pre-qualfied someone over the phone today who plans on attending my open house tomorrow. Here's the outline of the situation: It's a mother and daughter with child. The daughter is disabled and gets SSI. The mother wants to only have the daughter on the lease but is willing to co-sign. The idea is so her daughter can get utility assistance through the electric utility's subsidy program. The mother wants to be approved as an occupant, but wants her daughter to be the only one on the lease for this purpose.

Assuming mom is strong, would you consider?

In my area I would probably end up filling out a landlord statement for them to get there benefits and regardless of who is on the lease I would name everyone living in the house on the statement --72.231.xxx.xxx

I would consider having the mom sign a separate GUARANTOR agreement with a statement she is not living there so she is collectible. (Never do a co-sign as they can be thrown out. )

Me, personally I wouldn't. But that just means the daughter would move mom in without you approval.

IMHO, your opening up a bag of worms. What's next? She applies for financial assistance and you again have to lie.

If Mom is going to live there she must be a Lessee. If she is not going to live there she can be a Guarantor as Brad said. Check to see how to do this in your state. Brad said he uses a separate guarantor agreement. Here, per the advice of my attorney, they are listed in the lease as guarantor and sign the lease as such. --70.178.x.xx

I will give them credit for trying, the other stuff makes great -real news- and I want to be on the side of the tv where I can turn it off and go to the auction. The adults would have to be on the lease as jointly and severally, SSI people have non collectible written on them with almost invisible ink - I can see this with my L-ray vision (that L is short for landlord), no even a guarantee-or cause there is nothing to garnish or no real property there anyway.

This is similar to a mother with a child who qualifies for Medicaid because the father does not support the child but they are all living together. If they are telling you they are going to lie to get utility assistance and you enable them by not putting her on the lease, you are considered just as guilty. --162.82.xxx.xx

This reminds me of the folks on Section 8 who call asking if I'll take their voucher. I tell them the house has not been approved for this.

Most give up at that point but some try to sell me on the idea. Been there, done that; no thanks! I tell them what my local Housing Authority will pay is far lower than my rent. Most always offer to pay the extra "under the table" I want to ask them if you've got all this money why are you on this program?

I'm sure some landlords do this. I don't and won't.

If they can't even pay the electric bill without assistance when are they not able to afford the rent? Before you even met them there is some long winded sob story. I run from people like this.

I do the same with Craigslist workers. The moment they tell me their life story which is usually the first day or hour I meet them I cut them off and say I don't want to hear it. Business only. I'm so sick of people's stories that they want to tell me. --173.239.xxx.x

Exactly.

It's one thing to live on assistance if you've got it set up right (whatever one thinks of assistance). It's whole another thing to ask someone else to lie for them to get extra benefits, and commit fraud. --72.188.xxx.xx

Mom is dumping daughter on you and you will have your hands full. I would not take them. Mom is not coming. If she does show up they are asking you to do something illegal which will soon be caught and there goes the public assistance. This just happened to me sort of. Long term good paying tenant's granddaughter got pregnant and wanted to live with the baby's father. Their other choices were to live with his mother or separately at their own parents homes. So when tenant agreed to cosign I took them based on the fact that they both worked. Female soon was not working of course. The male was well liked at his job but that soon began to change. Then I found the skunky pot smell in the hallway. No one wants to employ some one who smells like skunk. You can ask what the disability is but if it's mental there will be trouble. I would pass, trying to beat the system out of the gate. Next they will be trying for rent assistance when they don't have the full amount of rent due on the first. No side deals with mom and when you have to try and put the puzzle together it's best to pass.

What will be your plan if they don't receive utilities assistance one month or get kick off assistance and can't pay rent? --72.24.xx.xx
