Looking for a Sample Form for security deposit expenditures. I would like it to have a statement that will pass legal muster that says It is a demand for payment where expenses exceed the deposit. Do any of you have any examples you would be willing to share? --70.184.xxx.xx

Nothing magic about it, not really anything need "legal muster".

Date, description of item, amount, charged against deposit or credited. Totals are always helpful. Statement should have a heading stating what it is, and include date (of the statement), referencing tenants name, property address, and landlord letterhead. Signature of landlord helps to authenticate copy.

I use a simple table which I can't recreate here, but basically:

"Dear Tenant:

Below is the final (or interim) account of your Security Deposit:

----------------------------------------------

Total Security Deposit $XXXX.XX

Line Item One ($00xx.xx)

Line Item Two ($00xx.xx)

Total Amount to be Refunded (or Amount still due;) ($XXX.XXX)

-------------------------------------------------

If there is an amount still due I will say, "The amount due should be sent to (mailing address.)"

If there is an amount to refunded, which is usual, I will say, "Thanks for your care of the property and the condition in which was returned. Your Security Deposit refund is being sent under separate cover by the bank and should arrive by XX/XX/XXXX." --50.82.xxx.xx

I use a simple XL spreadsheet. Lays out the terms for payment of outstanding balances at the bottom. I also send along a demand letter for the amount as well. --104.128.xx.xx

If you have Word you can easily download a template for an invoice. Change the title "invoice" to Security Deposit Accounting and go from there. There will be columns to add items and associated charges. You will easily end up with a very professional looking document. --98.146.xxx.xxx

Hello Pat-1 and Pat-2, very basic letter to former tenant.

Dear Sally and Harry, from your 800bux deposit held since 03/03/03 the following costs were deducted,

line item 1(you keep the photo till court, but note the photo), replacement oven door damaged - 236bux smoky pie appliance service

line item 2 (again you hold all photos, when the tenant gets them they end up with a monkey wrench lawyer who says this was damaged before they moved in and you are stuck), replaced cracked/broken windows glass read door - 135bux splinters glass service

line item 3 (you already know about the pictures), deep cleaning 2nd floor north bedroom carpet - 99bux sale from royal plush carpet

Rent in the amount of 825bux for April as listed in rent increase 7 months ago.

Your balance after using the 800bux deposit (remember there was a rent increase - lotsa folks forget this) is 800-1295=495. Please remit the balance within 28 days to avoid legal action, thank you --76.188.xxx.xx
