Lotsa questions about this so I thought I would give a couple examples of repairs my tenants have paid for and a couple times has resulted in eviction for unpaid rent.

1.) tenant bumped garage door track resulting in door getting stuck in down position, I was able to raise the door then saw the track pushed inward crooked so I took a photo and tryed to bend it back enough to get the door to operate - no luck so called tenant and asked what to do about the crooked track - it must have been like that when we moved in (heard this more times than a weather forecast in morning tv and radio combined), well mark it wasn't or the door would have never opened smoothly like it has the last 16 months, I am going to leave it up so you can get out your car after work (takes the bus mostly but does car pool and drive on occasion) but since I can't give it a quick fix I am going to call a door company and explain the shape of the bent parts, acn I give them your phone number to discuss payment - HECK NO I am not paying for that, well I suggest contacting your insurance to see how they can help, I did not do this and I am not going to spend any more time with it, the door is open. Later that day the door company comes, calls with estimate and I call tenant - who again says not paying so I ask door company to put me on the back burner. about 6 weeks later tenant wants door fixed and I tell him I can pay but it gets charged to your next months rent cause I had nothin to do with hitting the side that is bent, next rent will be 1100 plus 360 fixing this door problem, I copy the door repair bill and send a rent bill for 1460 using fedex photo delivery (the system my court uses for service since nobody wants to go sign at the post office) and next month payment of 1100 shows at the bank, I copy the original letter and photo of delivery - send another rent bill for 1460 plus 8bux delivery fee and a reminder the next payment will be towards the repair and leftover towards rent ( I gave 30 day notice required by my state laws, but tenant ignored repair bill - now gets a delivery fee added), so full prompt payment will avoid legal action for unpaid rent, pays the 1468 next rent cycle.

I could prolly charge a interest of some kind like rent-a-center but I want him to stay, he did for another 3 years.

2.) tenant calls after a rainstorm, drain backed up in basement, 3 inches of filthy watery stuff, I only do wall drains so I explain the drain cleanout cost goes to the tenant after 30 days (been there 4 years and noting happen in spite of heavy rain at least 3 times a year), I would cover if in 45 days or so, everybody that paints and cleans these houses uses the water plus bathroom and we would know if something is stuck or slow, she says it just happen but I see memory marks on the furnace that sits on 2 inch blocks but I call mr powerdrain cleaning and he is 3 hours away so I go get a sandwich and return after getting some supplies at the electrical store for a project I was gonna do that day, drainman arrives about 20 minutes later and gets the large snake into the basement and into the main cleanout there (I always add this just for this reason, otherwise they have to go through the toilet hole), into the drain about 18-20 feet and pulls back something white with stretchy cords - baby wipes, I take a photo of this coming out on the snake, save in a freezerbag, tenant is trying to find the bag where it says these are flushable (did find it and I gave her a print to send for reimbursement), back into the cleanout cause the water still standing still - again about 20 feet and pulls out a gob of hairy stuff, I thought she flushed a dead puppy down - saved that too, no carcass just hair extensions used for I don't really know what, back in with the snake cause the water still not going down - this time about 45 feet out and snake gets slowed down so they pull back something the size of a shirt, photo and too big for the freezer bags - has buttons and arms, pajamas or straight jacket? in with the snake again to be sure, the water is slowly dropping and out comes another shirt and the water now gurgling away - drain is cleared! drainman says going in again to be sure, this time the whole spool goes in and comesback with nuthin! tenant has came back - sister found the baby wipe package, they see the stuff in the bags and claim it was from the drainmans previous job cause they never put anything down the toilet, well we went around for 2 months using fedex photo delivery and I returned the balance that would go towards rent (325bux) and filed the day after fedex photo delivery, posted the 3day and proceed to court morning of day5, gone with her attempt to get baby wipe repayment, judge said if you can work it out with Mr Vee great but what we have seen here is negligent use of the drains and this is all under tenant control, Mr Vee does not use anything connected to your drain - admitted the baby wipes by getting the claim sent to them, 7 days till moveout. --76.188.xxx.xx

This is why an accounting/payment application clause is very important in leases if your state laws allow. Here in PA, payments can be applied to repairs, late fees and etc and then to the rent thus creating the option to evict if the repair reimbursement is not made. Wallet training does wonders by shifting the consequences to where they belong. --64.121.xxx.xxx
