Can I tell a tenant I've previously approved four days ago, that I don't any longer wish to rent to them? And do I even need a reason??? Issues include demanding a lease drawn up prior to even receiving our required application fee/reservation fees. Demanding/rude calls where I am completely disrespected, yelled and full on cussed at, because I don't meet their demands on their time frame. I just received their app fee, 2/14 sent application/credit report same day and 24 hrs later 2/15, after 5 phone calls demanding I process their application immediately, begrudgingly wrote an approval to them, today is the 19th and I'm being told it's taken a month to get a lease drawn up, how I don't know how to do my job, how i'm a piece of S*!T! This included another demand that they get their lease by the end of the day...move in isn't until 3/15/18, I wouldn't have had an issue in doing so, but they aren't my only applicant, and frankly, my work doesn't revolve around doing what they want when they want it. simply asking and not screaming at me, and telling me I don't know how to run a business would have worked much better. No money has been tendered. Nothing besides a email stating they were approved was sent. My plan is to return their check and tell them we no longer wish to rent to them. --73.144.xxx.xx

Legally, you PROBABLY don't have to rent to them, although most states recognize verbal contracts and this appears to be one such contract.

Next time, make up your mind BEFORE agreeing to accept their application.

I made a rule in the past....applications are never "approved"....they are "approved subject to final review and confirmation." This allows us to go back the day of lease signing and find out if they are screwing their past land lord out of the current month's rent, to re-verify their eviction report, and--as in your case--to deny them if something goes haywire at the last possible minute.

I have walked away from signing a lease that we were 3-pages into initialing when the tenants started getting uppity about wanting to make all sorts of changes to the place (Can we paint? No. Can we have three extra pets? No. Can we have install a pool? No.) All stuff that was covered in the lease I had sent them to review earlier. Tells me they never read the agreement and were going to go ahead and do it even if I said No and the lease we signed said not allowed.

I sometimes start to get a sense for what people are really like when it's crunch time. I try to never paint myself into a corner by giving "final approval." If I do slip up and say approved, then I'd just tear up the lease, refund their application fee, and let them sue me in court. Odds of that happening are slim and I'd much rather risk that than take on the know problem of a terrible tenant. --173.17.xx.xx

Once I gave an applicant verbal notice that so far their information has checked out and they were the "first" in line for the unit. I had other applicants that turned in their documents later that day or the following day.

Then the "first in line" started to demand changes in the unit. They demanded a second window air conditioner. All of a sudden they had a dog. Then they wanted their parking space moved from a carport space to a garage space. These people were a "protected class" and if I did anything to wrinkle their feathers, it would be a law suit in the making.

So I pulled out their file and credit report and called their landlord before their previous landlord on the application and the manager told me they would "never" rent to them again, they cause too much friction between other tenants of the property. THIS WAS MY WAY OUT. I called the applicant back and informed them that they were being rejected -- not for credit reasons but for other reasons. They wanted to what it was and who said what about them. I told them that the reporting party did not wish for their name to be released, but it's in my file and available upon an official request, like a credit company, police or other agency.

And next time listen to your gut - should have never approved them if it had to be done begrudgingly - you already knew. Live, learn, move forward & do better.

Absolutely under no circumstances should you sign a rental agreement with them. That is when you really have a legally binding contract. You don't yet, so back out.

Vee's rule of 'get a three ring binder and put copies of your states' laws applies here. (I'll let Vee spell it out, or, search for posts about it.)

Some states require you to tell an applicant why they have been denied, many do not.. If your state does NOT require you to tell them, do NOT. No good will come of it.

You do NOT want this tenant. Is there a local Apartment Association, or REIA (Real Estate Investors Association) in your are that you can contact? Knowing your state and local laws, and following them to NOT Rent to this tenant are very important.

Any applicant that swore at me would be told once that I do NOT. Tolerate abusive language, and our relationship is over.

Who is it on this board that says 'mark their phone number as Do Not Answer.' And then follow your phones' advice . (Debra, you just need to make sure you follow your locales laws in doing that . Once the proper steps have been taken, then you'll want to block their number.)

My first criteria on my written list of screening criteria is 'how does applicant interact with me and the people in their group?' In my state, I do not have to give a reason for denial, and, I may deny after an acceptance has been made.

Don't sweat negative social media reviews. The kind of people who take those seriously aren't the kind you want to rent to anyway.

I was just looking at a review from Google for the local Chik-fil-A. The person gave it 1 out of 5. In my view, is like the worst dive in the world. The reason given? "Drive thru was hard to find and lobby area was crowded during dinner rush, but the staff and food were nice."

They walk among us and they vote. (shudder)

If you want to have fun, try this...

"Thank you for informing us that you intend to write a negative review. We take all negative, unwarranted reviews seriously and will press libel charges for all false, misleading, or unreasonable statements made against our company."

Just like the tenant, until the lease is signed, either of you can part ways. Trust me, get out now. It will be a lot worse later. I recently gave a 30 day notice to someone who moved into a unit 10 days prior. It was the right move. No one wants to rent to abusive train wrecks. It's funny how nice people ace when they realize who is in control. Do yourself a favor and kindly indicate with them that the owner has declined the application and that your sorry tbings didn't work out.
