We've had a lot of worries posted recently about everything imaginable....ESAs, weird applicants, do you enforce your lease, etc. I wonder, how often and how severely have any of us actually be in trouble with the law on these matters?
So, if you could, please either answer "NEVER", or if something has happened to you in the past 10 years answer the ones below that apply.
1) What was the offense you were accused / charged with? (fair housing, ADA, etc) This does not include tenant's or their lawyers whining or threatening...I mean you got OFFICIAL LEGAL NOTICE from a Govt authority. I'm not looking for minor city code violations like tall weeds in the yard.
2) Were you investigated, as far as you know?
3) Were you taken to trial/hearing?
4) Found guilty or not guilty?
5) If guilty, costs to you (judgments, fines, penalties, etc), or if not guilty, costs to defend yourself (legal fees?
As for me....the answer is "NEVER." This is meant to be a poll....so while I know Robert J from CA will take the cake on this, we probably don't need a 1000 word essay. Mostly "yes" or "no" and brief answers (1-3 sentences) per questions should suffice.

I know you said no minor city ordinances but I'm going to go off beat just a little bit. I now have about 10 tickets posted against me that the city cop has written. I am fighting them all the way. I can show them in their own city ordinance book where they are wrong but they won't listen. I have now spent somewhere to the tune of 12 K to fight these. If they're wrong they're just wrong. So I now have turned around and pulled a Robert and I have sued my City. This has been going on for about 2 and 1/2 years and I would hope I can get it settled sometime this summer. This would be where you got notice from an official source that you potentially screwed up something major (i.e. discriminated against a tenant based on race, tried to charge a pet fee for an ESA/service animal, etc). A notice that your tenant is not mowing the yard as often as he should would be too minor for me to be concerned wit.

I have participated in:
retaliatory eviction (once), discrimination against family status (once), defense against improperly withheld SD (numerous), defense against protective orders (twice), suits charging deliberate psychological abuse, civil harassment, breach of oral contract, illegal recording.
On the other hand, I have initiated suits for eviction, damage beyond SD, protective orders (once against an attorney), withheld rent and civil harassment.

Once a person has served their time for a crime, they do NOT have to incriminate themselves by tell you of this! So all of those questions serve little purpose. As fewer questions that require an exact answer -- Like "Yes", "No" or "describe".

Was accused of racial discrimination, was investigated and the process took approx 5 months. Investigators on property questioning tenants, calling them, and even requiring a breakdown of all ethnic races of our properties. Sworn depositions and reviewed one year of approved/and rejected applicants. After the conclusion, was found to be no merit in the matter- case closed. No fees, beyond our lawyer cost.
Was also accused of not returning a security deposit within 30 days, it was actually 34 days before the tenant received it, they took us to small claims, regarding the double security for receiving after 30 days. Additionally, they wanted all their very valid damage charges removed, and flight/hotel and meals paid for coming for their case as they moved out of state and the judge did not award them a dime. The judge basically laughed them out of the court. We provided them an invoice of damage and costs, w/ labor, and provided the court, the receipts of replacement/part purchases and dated photo evidence of damage. --73.144.xxx.xx |

Was contacted by Alderman's office and police department many times over the actions of one tenant. Crabby old neighbor lady was an unhappy person and took it out on any targets.
The family's offense? The kids played basketball, in their driveway, by their garage, during the evenings and on weekends, after their homework and chores were done.
I finally threatened to get the fair housing office involved. One cop had even said , I wouldn't want to live next to that. (Yeah, cuz in Milwaukee Wi, we really don't want 14 year olds playing ball .) I invited every cop I talked with to come join in the ballgame.
Alderman had sent me a threatening letter and said the next step would be fines. It called his office and said I had a call in to Fair Housing, based on discrimination against families. Never did hear from FH, but also have not heard from cops/Alderman's office since. --172.58.xxx.xx |

Yes. First tenant. Various & sundry offenses, child endangerment; in-inhabitability; violation of quiet enjoyment; harassment, some other stuff I do not even remember.
YES.....at mediation, not at residence. They had
"Free lawyer" we had to pay ours.
Again, mediation first w/ settlement reached. [we knew it was BS but also knew how to play the game)
4)Settled, no "guilty" just made it go away. They broke settlement on the way home from Court. We found out 2 days later. "Our lawyer had a hand in screwing it up. Long story.
We sued. After asking head of mediation if their agreements had any weight or validity or were just toilet paper. Asked politely but as written. Mediator was head of the department and was not amused.
5) If guilty, costs to you: Not guilty BUT....First time 300.00 legal [flat rate guy] costs to file/prepare 50-100 +/- .
Went to Court to annialate. Won. Hired a local judge [from another district] 1,000.00 [CASH ONLY!!]
Won judgement & possession. Lost about 450.00 net. Got paid...took about 3 months of chasing and more threats.
Learned our lessons here, starting with Aldo's Rule #1.
Tightened up our procedures and became un-afraid of vacancy. Have had 7 good years since then.

I once got a call from a Fair Housing tester. I knew it was a tester because the call came in on our unpublished FAX line. The FAX line is only listed with our Secretary of State's office. It was also several days after we had issued a notice of non-renewal to a constantly complaining inherited tenant. The tester asked very sweetly if we had any vacancies. I told her that we had one unit which needed a major remodel. I did not know how long the remodel would take, but to watch Craig'sList as we would post the vacancy there when it was ready to show. That was the last I ever heard of it.
I am sure the disgruntled tenant had made the Fair Housing referral. She was a nasty, unhappy person. --98.146.xxx.xx |

Sued by a tenant in small claims 2 years ago over a non-refundable holding fee issue. Ever been in small claims court for 2 hours?? Lawd have mercy.....thought his honor was never gonna bang that gavel. But he did. In my favor.
Was sued by a tenant for personal injury the day after he was evicted. Insurance provided a shark of an attorney. Went on for 3 years & the kid's attorney never did once indicate a dollar amount they wanted. Finally our attorney, after 3 different rounds of depositions & multiple continuances, demanded a settlement amount. Don't remember what they wanted but I remember what they got. A whopping $500.00.

First eviction I ever had, the tenant filed a counterclaim. They got a free attorney. I represented myself. They claimed the home was uninabitable because the water heater was not working. The judge agreed with my position that the tenant cannot turn of gas and expect the gas water heater to be repaired. The final damage judgment was less than I requested, but still in my favor.
The free attorney had requested court costs for his client, the judge was confused and asked him what court costs his client had. It took the attorney a while to piece together that I had paid the fees because I filed, they just did a counterclaim. Eventually, the attorney changed his request to be that his client just not have to repay my court costs, the judge disagreed.
The other one was a sub contractor that didn't get paid. He wasn't a very good worker or good at figuring out the legal paperwork. As I recall, he began getting some help from an agency (attorney general?) towards filing a mechanic's lien. He did not have any written contract with myself or the "general" contractor. I had a legal shield membership and my staff attorney though the service made a brief phone call to him telling him he did not have a case against me and he needed to pursue the contractor that hired him. Never heard more about it so I don't know if he ever tracked down the other contractor or not.
I am on the board of an HOA also and have had a few complaints we had to deal with there. One for employment discrimination, we were not actually subject to that law because of the small number of employees, so we did not have to defend it beyond showing our payroll records for number of employees. The other case was an attorney general complaint alleging misuse of funds. No evidence was provided, so there again wasn't really much to defend and our attorney just wrote a response and we waited a while until the case was closed because of a lack of follow up information from the complaining party.
Plenty of code enforcement notices also, but usually just something I have to remind a tenant to clean up.

How do you northern LLs avoid the slip/fall in winter times? Dump 30 bags of ice melt on a less than inch of snow? I got bunch slip/fall claims against me (3 or 4).. One due to a broken handrail, active case for last couple years..
If you rent to class C/D tenants, you will get those.. Thankfully, so far, the insurance company's attorney does all the work.. and my premium hasn't gone up due to no fault of mine. --216.208.xx.xxx |
