No more skunky smell in the hallway since I raised heck with the grandma co signer. Now I hear from downstairs tenant that there is an odor from the deck at night around 10PM when he comes home from work.

This will not fly when the weather warms and neighbors' windows start being opened. In fact, the houses are close and some may already smell it although real skunks are now walking about.

I need to get over there and find this condition myself though not happy about driving over there in the dark even though its a block and a half. Will get someone to pick me up so I can go see. Wondering if I should go to the police first after I observe and smell it or send them notice. I guess it's illegal so I need to report it first and I checked the state laws and possession can result in eviction from current rental. How would the cops evict them or make me do it I guess. Downstairs are smart young professionals and do not like that stuff going on upstairs. They told me that the people upstairs are "not nice people". So I know what I'm going to do, what would you do?

I would ignore it. My places allow smoking and I could care less what they smoke. You go over there at night and create a problem for them in your area and they might kill you. Cops could care less even if it is pot --66.87.xxx.xxx

Ok, I go with a witness and observe and say nothing at the time. I'm not interested in creating a disturbance in a nice neighborhood at ten PM.

This is a beautiful 1950s era neighborhood with stone front homes, brick colonials, cape cods and lovely layout and landscaping. People worked their whole lives to be able to afford one of these and the property taxes and upkeep. They should NOT have to smell skunky pot from a couple of twenty somethings. It's a highly desirable neighborhood. During the 2006 First Time Homebuyer's 200K handout from the D party, these homes were priced at 250 to 300 K.

I will then go with my witness to the police the next day and report them. I'd better do it fast since the gov is trying to turn NJ into pot friendly Colorado East. We now have internet casino gambling too and they want to make it a sanctuary state. If that happens I will try to sell and get out. --73.33.xxx.xxx

I thought NJ now had medical marijuana exceptions. Is that accurate or not?

If you do have them, then how do you know that they don't have one and can legally smoke it in your state?

But, I really don't know for sure for NJ. In MY state, where there are medical marijuana laws, I could get a witness and go the police and they would simply say "How do you know they don't have a medical marijuana card allowing them to smoke it?"

Then you could try to argue federal law, but that won't work and will just make the local police hate you for being an annoyance. They aren't going to argue state versus federal law for you.

I am astonished that some of you are so unprofessional as to suggest that I allow other tenants to have to smell skunk. I suspect that you are not owners, but managers or supers, Debbie. Downstairs is complaining and they pay twice what upstairs pays.

The drug dealers are two blocks down near the city line where I live. This is a much better neighborhood than mine. I have six units I three buildings and I live in a SFH in another neighborhood.

If the asthmatic or diabetic upstairs have medical marijuana cards they can show them to the cops. I'm sure their three month old baby does not have a card. --73.33.xxx.xxx

WMH Turkey is not illegal and not likely to get the cops there. I don't think these two professionals want to be questioned by the cops after the next door neighbors report the smell coming from the deck. Where I Live there are single family and three family houses.We have a one family.So I can't blame anyone for stinking up the place except the little black and white pussycat,that I mentioned earlier.He knows how to do it without any help from anyone or anything.When we bad the dogs,they always wanted to chase it,so that was always a problem.He got the youngest dog right in the mouth one time,that was s catastrophe.One we don't ever want to relive.Pot don't smell half bad compared to It.With the way it's being abundant,they'll soon have to legalize it.It's on the horizon..............................................charlie.............................. --174.199.x.xxx

Got to agree with Ally here. My properties are non-smoking, period. I don't typically know or care if they smoke outside and it's a single family home.

But for multi family properties....no smoking anywhere on the premises. If I rented a non-smoking property I would not expect to have to smell smoke from other tenants. I don't allow one tenant to interrupt another tenant's comfort.

Its just common courtesy, not to mention in most places it's still illegal and cigarettes, cigars etc...are equally as bad.

Feel free to enjoy your marijuana. Just not on my property if it's going to offend the other residents. --173.170.xxx.xxx
