My crazy, PITA tenant who left all her windows slightly open and unlatched, then complained about her electric bill and told me the stress was likely to cause the loss of her unborn child,moved out Feb 1 after I gave her the Happy Clause. We had an agreement where I did not charge an ELT Fee or charge any more rents after Feb 1, as long as she was out by Feb 1, turned over the keys, AND she did not shut off the heat before Feb 1.

Well on Friday afternoon January 26, she notified me by text the heat was off. It was 12 degrees out.Her tone came across as gleeful. When I informed her both the Lease and her Happy Clause required the heat to be on until she turned over possession, she became quite irate and threatened to turn me over to the Board of Health.

Under Indiana law and my Lease, I have 45 days to do deposit reconciliation and I require the last water bill be paid off and a forwarding address be provided. Today she sent three nasty texts demanding her deposit back as it's been two weeks. She still has an outstanding water bill. She never bothered to follow the Happy Clause agreement, and I'm likely to be coming after her for performance of the Lease due to her own stupidity. in turning off the heat.

I am thinking of not even responding to the texts until I send her the outstanding bil instead of her depositl. What would you do?

I would send her a LETTER (not a text) (with a mailing receipt) stating that, in response to her 3 texts (list dates) she should rest assured that her deposit will be accounted for in accordance with Indiana law. Nothing more.

Did turning off the heat do any damage? I realize she violated the agreement but if it didn't do any damage, I don't think you can charge her for it. You CAN charge for the water bill of course.

If she otherwise followed the Happy Clause, I don't think you can go after her for performance of the lease? She returned possession by the 1st as agreed - you were the one who said she could break the lease and not pay the ELT...

I understand being ticked off, but I don't think you charge for that. ;) --50.82.xxx.xx

Bare minimum, I'd turn her over to collections. They should start reporting the debt on her credit report, and if she tries to get it taken off you can provide evidence that the bill is owed.

If you think she's collectible, hire a skip trace service to find her, serve papers and get a judgment.

She made no attempt to honor the agreement, I cannot see how I now cannot enforce the Lease. Last Clause stated. This agreement,if completed as stated, will free Tenants from further rents after Feb 1. It was not completed as stated and at 12F, there was great potential for damages. --216.23.xxx.xx

Your tenant reminded me of my tenant that demanded her deposit before she moved out. She even had some 'lawyer' send me a letter demanding the deposit because she needed the money for the new place and I was unreasonable --68.32.xxx.xxx

Definitely what everyone else said above. Reread all their posts over again.

I would also ask a lawyer if the original Lease terms are now back in effect since she violated your Agreement to Leave Early without paying further rent when she turned off the heat. Judges do not like retaliatory behavior. You may have a case to sue her for the remaining rent now.

Must have an expiration date or they can use this against you in court a year from now.

I would tell her you will send the deposit money/accounting certified mail. I would serve her court paper taking her to court via certified mail. Generally service is the hard part with tenants. But if they are expecting the SD via certified mail, this is one time they will sign for the certified mail. You now have her served for damages. --108.51.xxx.xxx
