State Specific Question About: MICHIGAN (MI)

I have an accepted offer on a single family house. I need to give notice to the tenant as the buyer wants the house vacant.

I have the form DC 100c "NOTICE TO QUIT TO RECOVER POSSESSION OF PROPERTY". Is this the only form that I need to send to the tenant.

There is ample time to give the tenant 30 days notice and I have already informed him verbally that the property has sold.

That's state specific. Are you at the point where you need a form due to non-compliance or is it simply a formality?

My goal in a situation like this would be to have a tenants departure as smooth as possible so they don't get mad and damage the house, possibly compromising the sale. That's why I suggested casual conversation at first to feel them out. --50.107.xxx.xxx

Yes, we have had the conversation and I also reminded him that he could receive his security deposit back in full if all goes well. There was no cause for concern as far as I could tell from that conversation. He knows the building is for sale and he's allowed the property to be shown on a few occasions, so this is no surprise.

I have verbiage in all my leases (and I take time to cover it when we sign) that in the event of a sale of the property, the tenant may be asked to vacate.

I do understand that it is state specific, which is why I indicated Michigan in the beginning of my post.

I believe we may have misunderstood each other here. My apologies for any confusion.

No apology needed. I'm always up for a good RE conversation. Is this a realtor sale? Your realtor may very well have this type of state form. I'd start there.

You may be fine with hand written notice signed by a cooperating tenant.

Honestly, in order to satisfy the buyer, I want to use the state specific form and have all my ducks in a row.

We are out of state landlords and just need to be done with our Michigan rentals.

Yes, the lease was up and we are now on a month to month basis. My lease does indicate that in the event of a sale, the tenant will be issued a 30-day written notice which goes out today. We got the accepted offer yesterday and the new owner wants to occupy the residence. --76.238.xxx.xxx

Yes, you should be fine. It's good that you talked them first because, in my opinion, the DC100C comes off a bit formal. It makes it sound like you are evicting them for doing something wrong.

I personally would have just sent a written notice terminating the tenancy. You don't HAVE to use the DC100C -- you could say the same thing yourself basically.

But, yes, since you've already done it and you spoke with them first, it should be fine. It is the proper step -- it just comes off kind of harsh if people aren't ready for it. Luckily, yours were. :)

Thank you for the advice. I never even thought that I could do a written letter, but I did do a lot of communicating before sending it and we’ve also discussed this as a possibility so it was no surprise. I just feel bad for them.

I sent along a letter of recommendation to help them find their next place too.

We have more buildings for sale, so I’ll follow your advice with my other tenants when the time comes. Very much appreciated.
