It's been forever since I've had a landlord problem, but here I am again. I have a tenant I have to evict in collier County Florida. It seems you can only evict with a lawyer. I can and have posted the 3 day but now have to get a lawyer to deal with the County court house process. Her lease is up in April so I've got two more months. Florida leases are only allowed for 1 year. And then I'm going to sell the condo. My question...I am evicting her for only paying half $700 rent for Jan. What if I get a lawyer $2000approx. Then she pays the rest $700. Do I have to then try and evict her again in April when the lease is up? Or is it better to just let her stay for free (I know!) then evict her in April...once and for all since her lease is up.
I hate to waste $2000 on a lawyer in feb then again in April. Her rent won't cover the lawyer fees anyway. --85.203.xx.xx |

Where do you get the $2,000 lawyer fee? Has an eviction attorney actually quoted this amount to you? Here that fee would be around $300-$500 max. --68.63.xxx.xxx |

Hire an eviction service. The one I use charges $450 and it includes the filing fees. I used an attorney once and he charged a flat fee of $500. You don't need to wait to evict for non payment beyond the three day notice requirement. No way does an eviction cost $2000. --173.170.xxx.xxx |

I would call the court to check that you need an attorney. I only need one if the eviction judgement is appealed. Of course FL laws could be very different. I'm sure one of the FL LL's on this board can answer that for you.
I'm confused about having to evict her in April if her lease ends in April. Does your lease automatically renew? Send her a non-renewal notice now.

I don't live near the condo so according to our county I have to have a lawyer do it. I believe I, as the owner, could do it but no one else but a lawyer. I've tried contact two lawyers and only one got back to me the three day pay or quit costs four hundred dollars alone. But I had my agent already do that. The quote for filing fees is about one fifty then the lawyer charges a couple hours I'm guessing which amounts to something like thirteen hundred. I think his quote was eighteen hundred if he didn't have to go to court, much more if court was involved. Mother of tenant just called and said she's going to go to court with her real estate attorney friend to stop my agent from entering, FYI..I'm going to try and sell it while she's in it so there will be prospective buyers going in. Florida law allows that so I figure I have the law on my side. And they are too stupid to know the law.
