I Have bad tenant, trashed the unit, cat urine everywhere, things broken, holes in wall, etc., Etc.
She invited me to come in for a look at it to see what needs to be done so she can get her deposit back. Said go on in on a date she'll be there after taking her illegal cat to the vet to get fixed.She's decided to move, which is good as it avoided an eviction, a other tenants complain about the smell coming from the unit.
So I go there see it's totally trashed, though she thinks it's not and said she'd used to the urine smell...
Anyway, I made a list of what I need to repair and what needs to be cleaned.She's fine behavior wise.
She wants me to advise her about what to clean. I give her a list of what needs it, which is literally everything, it's gross. Im hoping she'll clean it. Though she really doesn't seem to think it's disgusting like we thought.but she's in a good mood. I leave. She's fine.Several hours later she claims we entered with out her permission 2 hours early and her boyfriend who's she had just earlier admit is living there, is her witness. So she wants notice of when im coming for repairs.
I said certainly she will. I provided her appropriate notice and went in to do repairs. She has no problem as long as I don't clean it for her, she wants to do it so she can get her deposit back. I said nothing about she'd being charged for the damage. So she'd fine, im patching holes, my helper is repairing the stove and replacement of handles she melt down to globs.
She seems fine for a while, then leave for work.
Suddenly boyfriend come in with keys to monitor me to make sure I don't steal or clean her message...
I told him he has no right to instruct me as he's not a legal tenant and is illegally staying there. He appologized and suddenly left. We go back to fixing broken stuff. 20 minutes later she comes back yelling to get out of her apartment. Claims her dad says she can kick me out if she doesn't want me there. Im in the middle of patching a hole he's putting toilet seat back on. She takes my tools and bucket and throw them in the hallway. Grabbing my phone from the counter disappear with it while im finishing the patch.
I have to threaten to call police if she doesn't return my phone and tell her she's going to jail.
So she now claims I am not allowed back in the unit with out her permission. I understood that management could do needed repairs with a written 24 hours notice in Ohio.Can she legally bar me from the unit? Her cat peed in the vent and when the heat comes on it fills the building with the smell. The rest can wait but I was planning on cleaning it out as she didn't know how to do it. As it's in the round pipe. I think this is a health Hazzard to the other tenants and have the right to clean it and enter with notice. (Old building central heating, people upstairs suffering)
Any advice on how to handle this?
It's really pungent to the ones upstairs from her. Won't be gone till 28th.

Hi Kim,
You need to do the following:
Tomorrow, call a local, experienced land lord/tenant attorney and have him/her evict this tenant.
Stop all communication with tenant. Ignore her calls, emails, texts.
Wait until after tenant is gone to do repairs. Confrontations that involve screaming and throwing things are how land lords end up injured or dead.
Remove yourself from the situation and allow professionals to handle this.
P.S. If this tenant knows where you live, do not answer the door if she comes over. Call cops immediately. --173.17.xx.xx |

A "keeping the peace" call to the cops? Proven notice served by a witness? Videotape the mess, bring a witness?
SUE her, get her out asap?
Forgot if the cat had been ever permitted. Try a "notice to cure, then EVICT. Enough is enough!

Even if you give proper notice if the tenant says no how will you get in? you cant push her out of the way and create a violent situation,not only illegal but dumb.Just evict her properly.Assuming you have a lower floor or a basement can you get in where the heat duct is from below and just unhook it for the time being? --72.231.xxx.xxx |

good grief, that's a mess. Not sure where to start...
how to get your deposit back is simply one sentence, not a hoop to jump thru with busy work - Return unit as you found it, take your dirt and smells with you
Find out your rights and run your program. you are letting tenant set the rules.
Never be that far away from your phone, good grief... threat to call the police, tenant takes your phone, how are you going to call the police now?
This is a mess. Get a lawyer, a mentor and read your state laws and exercise any that you can to get thru this. Post here for support... someone from OHIO will come along with help, maybe in your area ??

No right to touch your tools or your phone, scream, etc. She's nuts. How many holes in the walls?
Evict.
Don't worry about the smell for now. Offer the tenants who complain about the smell something to neutralize it and STAY away from looneytoon. Always have somebody with you if you go over to the building.

I don't understand why you were trying to repair holes in the walls before the tenant left (when they were on the way out). The only repairs you should be doing are things that affect the livability of the unit until they are gone. After they leave, you check the condition of the unit and return some or all of the deposit based on that. Then you fix and rent again.
Maybe (ok, not likely, but maybe) they will clean and fix things before they leave. That is the option you have to give them. This is probably not a unit you can turn around in a day, so plan on a vacancy for a bit. Unless you evict, it is best to just let the tenant leave on their own or maybe offer cash for keys, but certainly don't provoke them to do worst things. So once I see unreasonable damage I tell the tenant they have to move or will be evicted. They are not taking care of the unit and obviously have no interest in doing so. Why should I incur more monetary loss for their poor decisions. I immediately post my 3 day notice for damage to the unit. The deposit to be returned is based on how much it takes to return the property to move in condition. If I have to evict that will include the costs to have the tenant removed. The deposit accounting information and any refund if applicable will be sent within 30 days of tenant leaving the premises. I don't discuss with them the details other than the unit needs to be returned to my approved move-in condition.
In Ohio the tenant has the following implied obligations:
• Keep the premises safe and sanitary.
• Dispose of all garbage in a safe and sanitary manner.
• Keep plumbing fixtures in the unit as clean as their condition permits.
• Operate all electrical and plumbing fixtures properly.
• Comply with all state and local housing, health and safety code standards.
• Not intentionally or negligently destroy, deface, damage or remove any fixture, appliance or other part of the premises, or allow your guests to do so.
• Keep clean and use appropriately any appliances the landlord has provided and promptly tell your landlord if your appliances need repair.
• Not disturb, or allow your guests to disturb, your neighbors.
• Not allow controlled substances (such as drugs) to be present on the property.
• Allow your landlord reasonable access (upon 24 hours’ notice) to the premises to inspect, make repairs or show the property to prospective buyers or renters. Twenty-four hours of notice is not required in emergencies, or for the landlord to deliver large parcels, or upon agreement with the landlord.
• Not allow sexual predators to occupy the unit if the unit is located within 1,000 feet of a school, preschool or child daycare center. --66.42.xxx.xxx |

You said eviction even if rent was paid with 3 days notice? I thought it was 30 days for break of rules lease, sanitary conditions etc. In Ohio?
She's claims she's leaving on either 28th or 1st, should I just wait to see if she's gonna leave or put eviction no now? She's never given me written notice.
She's been sending me all kinds of weird texting this weekend. Starting to suspect drug use, or just insanity. Just demand a copy of her lease sent by texting photo to her while we're doing dinner. 45 minutes later threaten me as im breaking law and can be used in court for not giving it to her because she believes text are legal documents... just an example of her insanity...
Im ignoring her.
Meanwhile im getting complaint from others of loud banging all weekend.
What law clause say I can give her 3 days notice in the circumstances? If I provide her I want to make sure I know.
