At my local REIA meeting last night, a judge and an eviction lawyer who were the speakers, mentioned in passing that you could bar a tenant from medical Marijuana use on your property. While I do have in my lease no smoking, what is to stop a tenant from baking brownies? I also have a clause that no illegal activity can take place on the property including federal crimes so I would be legally sound for evicting a tenant for Marijuana use currently, but what happens if medical Marijuana is legalized at the federal level? I think it would be similar to ESAs and we would be forced to permit that activity on our properties. Has anyone done an eviction for medical Marijuana? Thoughts? --64.134.xx.xx

Smoking is smoking,i don't care what kind of smoke,if the unit is non smoking they can't smoke,if smoking is allowed I don't care if it is cigarettes or pot go ahead and smoke.I doubt cops around here would even respond if I called and said someone was smoking pot in a unit or even on a front porch.Why would a landlord care if they are making and eating pot brownies? my job is to collect rent not to try to be there parent and tell them how to live. --72.231.xxx.xxx

No need to legalize another problem substance. They will bar themselves from my rentals when they lose their jobs and don't pay. If I see signs of any substance abuse they don't get the unit. Maybe I got lucky, but I had potheads (heavy use) in one unit. When they moved out there was no smoke odor or wall discoloration from what I could sense. The only odor was dog urine on the bedroom carpet from their chihuahua. --72.188.xxx.xx

I see more people lose their jobs from getting caught smoking pot OUTSIDE of work -- than from losing their jobs because of pot "making them stupid."

Much as many might not LIKE it, the reality is that legalizing pot would likely mean more people keep their jobs than lose them from going stupid all of a sudden...

Medical marijuana can be 2 forms: one smoke it or 2 cannabis oil. Unfortunately the federal government has not legalized it yet. And in due time it will become legalized. Our Vets that have PTSD smoking MJ is very beneficial for them.

As far as baking with MJ thats their business.

As Landlords you may want to add into your lease that smoking in any form in the unit will carry a cleaning charge of $1,000 and a repaint charge of $______. What does it cost to repaint your unit? Then have the tenant read the lease clause and initial it. HOWEVER will the amount of the security deposit cover the cost for smoke cleaning and repainting? --99.56.xx.xx

It doesn't matter if a landlord fines tenants for smoking pot in a duplex or quad or larger building with a cleaning or repainting charge, because other tenants will leave when they smell that and the fine will never cover that loss of income. --73.33.xxx.xxx
