State Specific Question About: MARYLAND (MD)

This is a follow up to my last month's questions on 'Failure to Pay' filing in Dist. Court, Rockville, MD - tenant did not pay 1/18 rent timely that's due 1/1, I filed papers on 1/16 as his late rent payment ck bounced, I got a court date of 2/12 upcoming, but he then paid partial payment on 1/17 for whatever reason. As of now he hasn't paid February rent either nor any late fees. Now I got 'courtsye bill' for his water of $1550 yesterday. A bit background: he has been a tenant over a year now, lease ends 5/31/18. He's paying monthly rent in the past after several reminders, calls, etc, sometimes with late payments, but eventually paying. Since last month, he's become daring and piled up huge water bill above, that eventually will come to me if he leaves without paying. My question is: how do I minimize my loss from here on, what happens after 2/12 court hearing, what's the next step, am I doing ok so far other that filing for January a bit late, please help, have hardly been to this situation before, please help, tia. --96.241.xx.xxx

Vogol, hire a local attorney who specialized in evicting deadbeat tenants. The questions you are asking imply you are not familiar with this process, and the only thing worse than paying someone $500 to kick out a deadbeat is trying to DIY, fiddling around with it for 2-3 months, only to have to start over because you forgot to cross a "T" on page 3 of the petition.

Get a pro, get it done right. Get copies of all paperwork. Go to court, observe, and learn. Next time you might consider DIY. --173.17.xx.xx

Sorry to hear about your problem. Does he use autopay or does he deposit into your bank account? Either way, in some cases, stops eviction and the time has to start over. I'd get it to where he cannot pay rent to you unless it's in your hand. Then you can decide if you want to accept it or continue the eviction.

If you pay water, I'd be checking making sure you don't have a burst pipe under your house?

He paid partial January rent of $1720 on 1/17/18. Due was 1850 rent, 75 late fee, plus 12 bounced ck fee (1720 out of total 1937). He pays direct deposit into my account. He pays water, but if he leaves any bill after move out, it comes to me per Water company. Thx for your help.

So the suggestion is 'return him 1720, continue with hearing on 2/12/18, and hire a local pro' - right. Anything else at this point?? --164.82.xx.xx

So the question now is: To Refund or Not to refund the partial payment of 1720 out of 1937 total due, before the court date!!

I'm now confused. Any other experts here to chime in pls. My court date is next Monday. I don't have much time to find a lawyer as I don't know anyone, sorry.

Get attorney first. You might be able to escrow partial payment with the court. You don't want just anyone, you want someone who specializes in landlord-tenant law. They advertise this way. There has to be a landlord or building owners group near you or the local bar association can refer you for sure. --75.88.xx.x
