Current tenant's lease expires on May 31, 2018.

Per the lease, tenant needs to give me 60 days notice (so by March 31st) whether he wants to renew.

Tenant has not made up his mind yet about whether he wants to renew.

I want to like up a back up tenant in case tenant doesn't renew on March 31st.

Tenant is refusing access for me to bring prospective tenants to tour the house citing I'm invading his privacy.

Can you point me to California code on rules of access to show the house to prospective tenants when current tenant has not made up his mind on renewal.

NO fair to the backup person when you won't know until March 31. What are you going to say to that person? I don't know if this is available and won't know to March 31 but give me a deposit and maybe you will get it. This is wrong in several ways. I don't understand why landlords put themselves in a position where you have to ask the tenant what they are going to do? my leases simply renew automatically so there is no need to call them and ask them nicely to sign a new lease and chase them down etc. --72.231.xxx.xxx

You seem to really be jumping the gun. You have no idea whether the tenant will stay until March 31 and still have 60 days after that. I don't think many people would be looking that far ahead for a place either. So just let them be until you know. Things will work out better that way.

IMO, you would be better served focusing your efforts on keeping your existing tenant rather than finding a new one 4 months before the end of your current lease. If you reach the point that you cannot keep your existing tenant, then it is time to start looking for a new one. --70.178.x.xx

You tenant still has 2 more months before he has to give notice. If it is really important to you to show now and get someone lined up for the first of June, give the tenant notice right now that you won't renew and he has to be out the end of May. --174.216.x.xxx

I've had more current exiting tenants extend their stay because:

a) their new rental wasn't ready

b) it took them longer to pack then anticipated

c) their new place fell through

So if I was crazy enough to rely on my current tenants to be out and leave the place is good condition, I would have my new tenants left with no place to live and a moving truck loaded with their belongings. The cost of a Hotel averages around $200 per day and to unload, store and re-load a moving van runs around $800.

So if I was a fool and tried to line up a tenant walking out of a rental and the new tenant walking in the next day, I could be liable for $1,000 to $5,000 in damages... --47.156.xx.xx

We have a clause that allows entry to show the property either for rent or for sale. However, only the for sale clause be used before their notice due date. The right to show to prospective tenants can only be enforced if either party has given a non-renewal notice. --71.75.xx.xx
