Yes most areas require a 30 day notice of moving, this way the manager can come inspect to help the tenant get back the deposit and arrange intense work to be done the day after moveout - this is why holdover rent is double or triple because the workmen have planned to make a mess in the unit. When the lease ends, both parties had notice upon signing the lease, that it ends on a specific date. When the lease ends, right to occupy ceases.

Depends on the lease here: my annual lease ends but goes to a month-to-month so notice to end THAT lease would be needed. In NC, 30 days for Annual, 7 days for M2M and (I think) 2 days for weekly.
I have a PITA tenant whose annual lease will end soon, I'm waiting one more month so they are M2M then giving notice to end next month as soon as they pay rent.

A standard FL lease and FL law allows for automatic roll over into month to month. Secondly, FL law speaks to "written notice for termination" by either party and the notice must contain a specific date. It depends on several, possibly conflicting facts...
1) What your lease says
2) What your state laws require
3) How your judge interprets those laws if it ends up in court
Most of the above answers are probably true based on the poster's location, but they do not take into considerations that including a termination notice in the lease might not be enough. In Cali, maybe yes. In FL, maybe no. In FL / whatever town you're in / whomever's court room you end up...who knows?
A local land lord/tenant attorney who has been practicing in the area and knows the judges should know the answer off the top of his/her head. Ask the attorney and maybe he/she won't charge since it should be an easy answer. --173.17.xx.xx |

I'm wondering why you ask. Do you want tenants to leave at the end of the lease? I think whether or not it is required by law, it is still a good idea/professional to notify the tenant of your intent with ample notice, so that what they need to do is perfectly clear, and so that they have time to do what is necessary. Actually was just reading up on this topic. Here it seems to be if you have a year lease and you do not have in the lease that it is going to month to month auto after the 1 year and you did not send an addendum prior to the one year and the tenant is now there a couple months after the year technically the lease auto goes to another 1 year lease. My tenants live in my condo in Miami and because I live on the West Coast, I put in Lease they must give a 60-Day Notice of Intent to Vacate. They renewed for a 6 month term then Lease converts to month to month. I wanted to know for sure if they were leaving but they did not call so I called them and learned they are leaving at the end of the Lease! I requested a NOITV signed right away. Their 60 Days Notice begins tomorrow! some tenants do not read their leases. --24.18.xx.xxx |
