Hi My name is Kenneth and I'm in a situation I don't know much about. We were tenants in a home in Maryland. Then the home owners came to us and asked if we would like to be sublessors of the home. We agreed thinking it was a good idea. I was wondering if was even legal in Maryland to do so. And if we subleased to tenants that we want to evict what is the process. I need assistance with this A.S.A.P. For it is causing me stress and problems financially.

In MD tenants are automatically allowed to sublet unless your lease specifically prohibits it.

What I don't understand is why your LL would encourage you to do so? Was the rent too expensive? Did you have a history of being late with your rent? Are you currently subletting? Do you even reside there? Did the sublessor give you a security deposit?

Generally. if you are subletting and that individual is paying you directly and you then pay the LL then you are responsible for the eviction as well as the rent and any damages caused by the sublessor.

In some jurisdictions if the subletting party at any time pays the LL directly and the LL accepts the rent then they have now established themselves as tenants so that the LL would be responsible for any eviction.

You chose the sublease person and have to trust they will follow the lease, the damages come to you and you must collect - deposit money is not accessable until the unit has turned back to the manager with keys or court.. --76.188.xxx.xx
