Working on updating my lease. Hoping for help from fellow landlords from NY who can provide help.looking at auto renewal and was wondering how NY landlords deal with the 15-30 notice as indicated

In the regulations. This is directly from the tenants rights book from the

NY Attorney General. Thoughts?

For non-rent regulated apartments, the landlord must agree to renew the lease and a tenant may be subject to eviction at the end of the lease term. However, a lease may contain an automatic renewal clause. In such case, the landlord must give the tenant advance notice of the existence of this clause between 15 and 30 days before the tenant is required to notify the landlord of an intention not to renew the lease. my lease has a start and end date then says at the end of the lease term this agreement automatically becomes a month to month agreement.As far as I am concerned it is in the lease that it will automatically become month to month so the tenant has been given advance notice that it will become month to month,i have never had anyone say it was a problem,tenant or judge or anyone else --72.231.xxx.xxx

Our leases automatically renew for another year unless we receive 60 days notice prior to the end of the term. This will hold up in court but I also send out notices 75 days in advance as a courtesy reminder. It is setup to go out automatically by email. I think this would meet your state requirements. --71.75.xx.xx

The email renewal notice may work. This notice goes out automatically via your email provider? I would think this notice is sufficient to cover the notice prior to automatic renewal. Maybe I need a clause say email notices are acceptable form of communication to put the burden on the tenant? I’m just saying because tenants may say they did t get the email...just trying to cover all bases? --63.143.xxx.xxx
