Before opening for business it is always good to understand the tenant local and state rules, I suggest printing each and placing into a 3ring binder - flip over for the state rules so they don't get mixed up, landlord 101, next is visiting housing court to understand how the judge in your area treats the rules and flexes some, what you do is silently place yourself into into both landlord shoes and next time try on the tenant shoes so you understand how quick the court timing works in different scenarios, free legal lessons...

Back to evictions, the common is unpaid rent, post the correct notice and wait for the -whole payment-, most places if a partial payment is accepted then you must start over at the beginning so it is all or none, add the filing fees - the tenant caused the eviction... --76.188.xxx.xx

I have court for eviction coming up for unpaid rent. So my tenant is pregnant, I am afraid the judge feels sorry for her and drag on the eviction process. Like give her another month to move out. One of my friend went to court and he lost to a pregnant lady. So I am a bit worry.

Any advices?

Liza - my attorney has always told me that there is no excuse for unpaid rent. Unless the tenant has done the proper steps for an unlivable house, there isn't a whole lot that can be done. You also cannot discriminate on the basis of family status.

All that being said, if the judge says she gets another month, I'm not sure there is much you can do. Make sure you have all documentation needed (lease, PoQ notice, copy of served court notice, whatever else TX requires) and go to court. Good luck! --98.175.xxx.xxx

The same rules apply for at will or with a lease. You must give them a 10 days notice and a demand for payment. If they do not comply the on the 11th day you can file for eviction.

If you simply want them to leave and are current on their rent you must still give a non-renewal notice.

If it is a week to week they need 2 days notice, M2M 7 days notice, annual 30 to 60 per terms of lease -written or oral.

All notices should be in writing. with proof of delivery.
