Question for Ohio landlords. My tenants lease is up end of february. I'd like to give them 30 day notice to vacate that month. They have been paying late last few mos, 5th to 10th, but they have paid w/ late fee. If I give them their notice when they pay on 5th or so, are they required to vacate on March 5th or at end of march? I'm afraid if I give notice on 1st they won't give me rent money, and I need their sec. deposit since I know there are damages. Thanks to all helpful responses. --166.137.xx.xx

Advice for you. To give notice you must take a piece of stale bread and place it on their doorstep. Sprinkle 4 drops (not more than that) of water on it.

You need to give 30 days.

Look at agreed date on lease and make sure you are posting at least 30 days before.

Check your state laws. I used to think Missouri required 30 days, but NO...it requires "no less than one month from the time the time the rent installment is due". My attorney interprets this as the last day of the previous month. So if I want them out by Feb 28th, I need to give notice by Jan 31st. I read the law...it does say, "not less than one month"...nothing about 30 days. Dontcha love how vague laws are written? --173.19.xx.xxx

Hmmm. Colorado, marijuana, lack of sense. Yes, you may very likely move them to not pay that month but if you tell them that if they don't pay you will evict them and ruin their credit score, they may pay you to avoid that. --73.33.xxx.xxx

Maybe give them a notice right now that the lease is going to convert to a month to month.

Look up your state law to see if you can give a literal 30 day notice or whether you must give a notice that includes a full rental period. If you have to give a full rental period, you might as well bite the bullet and get it over with. If they always pay late and you must give a full rental period, you are never getting that last month rent or any part of it. --174.216.xx.xx

Ohio is a 30 day state with the tenant laws, so you give 30 days notice and they should also - sometimes they do and sometimes not, regarding late payments - this can hurt you in eviction court because the last 3 payments is the timing the way many judges rule on late rent and the cycle of posting, here is an example, tenant pays on the 4th then the 10th then the 9th and you wish to evict for unpaid rent on the 2nd - the judge can toss the case and make you start over or if she/he feels everything else is in order may simply award the property back however many days late you accepted late rent (in my example the delay would be 10 days), this is why poor management is a poor business acumen, no reward for sitting on your hands and you gotta know your court behavior with the tenant laws. So part of being a business owner is staying in touch with the trends in the courtroom as well as a good understanding of the local and state laws. Good Luck --76.188.xxx.xx

You must give a 30 day notice that you are not renewing their lease and to move. However they do not have to leave, they can force you to give them a 3 day eviction notice and evict them thru court. Please be aware that after you give them the 3 day notice, "YOU CANNOT EXCEPT ANY TYPE OF FUNDS FOR ANY REASON." All monies received will be considered for rent. I just got back from eviction court today. I was awarded $3,000 Yippee!! --71.72.x.xxx
