State Specific Question About: MASSACHUSETTS (MA)

Ok guys what is the laws on this please? What kind of documentation do they have to provide and the tenant, brought the dog unto the property without 1st asking so does permission have to be provided beforehand. Also the dog bit my plumber. Thanks --45.19.xxx.x

Btw, last time I checked, german shepherds are not on my insurance companies list. Check your assumptions against their actual list. Always let your agent know what kind of dogs are moving in as companies change their guidelines frequently. Wouldn't want to get in trouble for refusing a "known" restricted breed if, in fact, it wasn't restricted. :-) --173.19.xx.xxx

Get the rabies shot and report to county, chances are this animal is not gonna be a good pet, emotional or service animal, late in the summer I wrecked an ankle - the first week of having the pump-up walking boot a small dog bit me just above the boot, 4 times thru denim pants. They will already have the doctor paperwork and should already have shots documented with photo vet records, the dog will be quaranteened a couple weeks as a result of the bite - period, and I would be preparing the lease cancelation paperwork today.... --76.188.xxx.xx

The Fair Housing Act is what people are generally talking about with ESA. You have to reasonably accommodate your disabled tenants. That means if they have a medical professional say they need an animal, and that this animal fulfills that need they get to have it. There is no formal registry for emotional support animals. Lookup past discussions for more general info about this read the HUD memos.

You can evict them for failing to control their animal and for the animals dangerous behavior. --75.149.xx.x

The law is clear: dog must be well behaved.

So I'd deny based on the bite AFTER i get documentation it happened. Have the plumber write a statement for your defense file, plus a police report or doctor's report woudl be best.

Who am I to determine this issue - after all I am only the manager. But since all my places do come with the first year of renters insurance included as a move incentive. It would be my duty however to mention that an ESA with a history of biting is at that address to the agent. If the insurance company, who is insuring you along with the the resident makes the business decision that the dog has to go......its not your fault.

Do the coast guard salute, shrug your shoulders and pass this on to the insurance company. The insurance company will make the call if the ESA is at risk or not. As a LL we are evil to begin with - there is no sense in making us more evil so the resident is less cooperative.

As a side not, at the one year mark - the resident will get a bill for the renters insurance. I use this $120 bill as an incentive for the resident to go it another year --24.101.xxx.xxx

You did not say what size this dog is. By way of reference, here is a sad story told to me by a building inspector. A plumber went to a home where the owner was not paying attention to the situation. A tiny Yorkie, maybe a couple of pounds was annoying the plumber. Yorkies are barkie and can be nippy. The plumber without looking, swung his wrench and hit the little dog in the head and killed it. He decided to put the dog's body in his tool box and he told the owner that the dog ran out the door. Did you see the dog bite the plumber by the way? --73.33.xxx.xxx
