After about 12 years, we unfortunately will be getting a new Judge for our small claims court. Due to sins of the current judge, he dropped out of the race today. I really like the way this guy ran his courtroom. Now I have to learn a new judge. We have two running for this seat now. Tomorrow I will be meeting with one of them to see if he will get my vote. I’ll be making up a list of questions first. Do any of my fellow board members have any questions I should ask this new prospect? --75.141.xxx.xxx

All politicians (judges included) will tell you whatever you want to hear just to get elected. Once elected, they usually sing a different tune.

You will never know any judge until you stand before him in HIS courtroom. In your case, I would volunteer to help him get elected,...that will pay huge dividends if he gets elected. --68.63.xxx.xxx

In NC we get a pamphlet on every judge (re)running for election outlining their experience and previous history and if currently a judge what causes they've embraced.

Can you lookup their experience. Do the editorial boards on your local papers provide insight? Normally they do background info so people can make informed decisions...which clearly isn't working. --71.75.xx.xx

Ask him about his young adult years. Did he work in college? What was his first job? Was he ever broke? Or did he get a free ride from Daddy? (Rephrase that question-- my sour grapes are showing!) How does he determine what is "fair"?

A person's early years greatly influence their outlook throughout the rest of their life. Judges are supposed to rule on law -- but how that law is interpreted gives the judges a lot of leeway.

I worked my way through college and was no stranger to poverty in my young adult years. I learned to defer gratification, save for what I wanted, and be a hard worker. It made me feel that, if I could do it, anyone could do it. I would be a tough judge. --98.146.xxx.xx

Does he own or has owned rental houses? IF so what was his worst experience with tenants?

Does he know the Landlord Tenant Law for your state. What would he change in the law if he had the opportunity make changes to the law?

Why does he or she think they will do a better job as judge than the other candidate/opponent?

IF he or she is a lawyer, what is there rating? Have they represented Tenants or Landlords as a lawyer? What was the outcome in general of the case? They can not give specifics due to client/lawyer.

If elected as judge will he stay as the judge or plan to seek other elected positions? Higher levels in the court?

Things you would like to asked but can't...

Would he take a bribe?

Has he ever broken the law?

Has he ever LIED? And if so was he good at lying????

Does he owe any financial favors to any of his big donors???

Does he favor tenants over landlords or landlords over tenants

What skelton's does he have in his past? List them???

Me? I'd type up a list of policies and procedures that have worked "to help them once elected." If each will continue the great practices that have helped the community so far I'll vote for him.

Such as 1 week to vacate and 2 weeks if children are living in the home.

Defendant cannot ask for more than one delay and it must be submitted 48 hours in advance.

Honor late fees and ELT.

$35 per hour for LL labor...

We have judge candidates come to our local LL assoc meeting to debate.

This is your opportunity to EDUCATE and TRAIN your future judge. Questions about corruption etc are pointless - you know how he'll answer!

I showed my judge a chart we made of EVERY court public record eviction in the past year and the dollar amounts of the judgments. I also estimated the "evictions" that did not go thru court.

The total for our entire county of 60,000 people came to several MILLION dollars that local LLs ABSORB while providing affordable housing for the community.

We LLs need the court's help to remove deadbeats and open up the housing for decent people who are working hard and trying to get by.

When the court gives the non-payer more time it's a slap in the face to the people who work double shifts and go without to keep up their rent.

Allowing more time ENCOURAGES deadbeats to not pay and REWARDS them for bad behavior.

Keeping up the rents also discourages crime.

Also, MANY LLs live off their rents. The court has a duty to protect their only source of income.

We need the court's support to help the community.
