After accepting my tenants notice to vacate Jan 1, 2018, the tenants have not relinquished the keys to me, and appear to still be there. Since they are in possession of the house, can I ask for prorated rent this month up until I get the keys?

If you do, then you will have agreed to continuation of the rental agreement and the notice to vacate is cancelled.
That doesn't mean that you are not entitled to rent. Once the tenants are out, in CA, they owe you rent and you can THEN ask for the rent and try to collect it.

Moshe is correct that by accepting rent while they are currently in residence, you essentially waive the notice and are back at a month to month lease. That's how it works in my area too. At the very least, it complicates things. If you are wanting them out for some reason, then file papers today.
It's the 9th...way past time to take action. They either need to pay up today or evict them as hold overs. In Missouri, I can get double the rent for holdovers...might check your state's LL/T law and see what your options are. --173.19.xx.xxx |

Per diem rent is calculated by multiplying by 12 then dividing by 365 then multiplying out the number of days. Sometimes you have to evict if they refuse to leave where can advise from a landlords association. Google to find one. --168.244.xx.xx |

Actually, in CA and most other courts, daily rent is calculated as monthly rent divided by 30, regardless of how many days in the month (365/12 = 30.42... days in month).
This has the advantage (to the court) that rent for a day in February is the same as it is for a day in December, which is an important property to the court.
