My contract with my tenant requires a written 30 day notice. Does a text, stating a tenants desire to move out serve as an official written notice, especially when the tenant in the same text requests an email to send me the official written notice? --166.137.xxx.xx

It goes beyond the lease. If you have a history of corresponding with a tenant via e-mail (which we never do), if it goes to court the judge will probably side with the tenant. --76.120.xx.xxx

Whats the difference?

You got the text, no question. You now know that the tenant is going move out and you know on what date. You have proof that he notified you and what his notification consists of.

Write him back a letter accepting his notification. If he doesn't object that he never gave you notice, then what have you lost?

Just my 2 cents. I do communicate by text with my tenants but for moving out, I tell them (and my least states) they need to write it out and submit it on paper. If I have to go to court for any reason. Getting something off my phone that is not up for scrutiny to present to court would be too difficult. --69.160.xxx.xxx

I take text or email, I just want NOTICE! If they are choosing to break their lease for whatever reason, I do ask them to follow up with a formal email rather than text, spelling out last day, etc. but otherwise, to me, notice is notice and I just get ready to rent again. --173.22.xx.xx

The idea is that this tenant has changed her mind in the past, and I was expecting to see her 30 day notice by way of email as she stated she would do, but did not until Dec. 20th 2017. I am asking for prorated rent, 20 days since she sent her notice via email, as opposed to the text I received in November 2017. She never responded to my texts nor letter via process server asking for verification that she still planned to move out Jan 1 this year, until Dec 20th '17.

I should include a clause in the contract next time that states No texts allowed to serve as a 30 day notice. It is better to have a signature, either on paper via US mail or electronically by way of email. --76.14.xxx.xxx

The issue to me is communication. I take text, email and letters although I haven't received a piece of mail or a phone call from a tenant in at least 5 years.

If you think about text and email they have the benefit of tracking date,time and sender's identity. Can't say the same with mail.

In NC text is allowed although in small claims it must be printed out but District will accept looking at your phone. I use a program that saves all of my texts as PDF's which I file with the tenants records so I always have a copy for whatever.

Our normal routine for renewals is I send a renewal notice (via email) 75 days before their renewal (we require 60 days notice) reminding them that we need 60 days notice and if they are staying their rent increase is XX%. I require a mail received notice. Works perfectly. --71.75.xx.xx

In most of my courts no text, it depends on the court, none of them accept camera pictures unless you surrender the charger and phone till the case settles - they need to be able to share among other court staff - maybe the same for texting in your area but here moving stuff has to be on paper. --76.188.xxx.xx
