Happy New Year, everyone!!!

Let me share with you all the latest episode, I am sure you are going to kick out, so you can form your own opinion.

The male tenant and his girl friend had been tried very hard for not paying the rent and get free money from the beginning, they had done it and won free money from their previous lease. They planned to do the same on my lease.

At the beginning, the tenant used roaches, rodents and water heater tried to get away with the rent. But, I know my property, so he had to back off.

He refused to let me do the annual checkup on the furnace on two Weds, I had to cancel it twice, because they do not want to remove their killing dogs from the premises.

Yes, I did meet an attorney, when the tenant won't let me do the annual furnace check up. He advised me to stay cool and calm, don't do any thing, so I did not do anything.

On 12/18/2017, he sent the request for house repair items, and he indicated " no urgent matters".

(I took the actions right away.)

Again, he insisted to have it done on Sat. (the tech I used does not work on Sat.), so I had to ask for a special for the tech to come.

It turned out, the furnace is in good working condition, none of his complain were true.

However, when the tech and I wanted to enter my property, the tenant blocked me and won't let me come in with the tech, he physically blocked me and did not want me to enter my own property, he pushed me and told me not to get into my own house, and he cussed me and demeaning me and pointed his finger to me and said I am “crazy’, and “ creepy” and he made many hand gestures toward to me while I was in my own house. He even tried to grab my cell phone from my hand. (from 11am to 11:30am on 12/30/2017)

Then, the plumber came and replaced the toilet fill valve, the plumber told me there is NO high water pressure issue in my house. The water department asked me how did the tenant claimed the problem of high water pressure. The toilet fill valve is still quite new, but I replaced it anyway and the plumber charged $50.

The third thing, he claimed "the mold and the roof leaking". I had checked my property in details before they moved in. The property has never have mold nor leaking.(I won't allow it, I know my property inside out.)

But, the truth is the tenant can literally pull a cup water in the attic and claimed the leak and mold, so they don't need to pay the rent.

The roofer was making a special trip and was schedule to do an inspection today, Sunday, but due to the wet weather, the roofer cancelled it this morning.

The male tenant emailed me that insisted to have an roofer today, otherwise he is not going to pay the rent.

The male tenant even complained that I caused his girl friend emotional panic, so he can get free medical money.

I asked them to move out my property in the last five months, the male tenant indicated and expressed to move out my property six times, but still occupied my property.

Now, they intend to stay with rent free, because the roofer cancelled the inspection today.

The tenants plan to repeat the same trick as they did their last lease in my lease.

The male tenant even told me to find a man, and sent me the link of divorce101. I received plenty insults and false accusations from him.

Yes, I am very aware If today, I was a white, male, 6' tall, the male tenant will not behavior the same way as he did to me.

Now, the male tenant said he is not going to pay the rent, because the repair took too long, and the roofer did not come today.

Do you know what kind of agency that I can hire to deal with this tenants? I will be away for a couple months, I am very sure the tenant is not going to pay the rent. He even described to me how the eviction process goes.

I am very afraid of this dangerous tenants with their dangerous dogs. (the emotional disability). Too bad I keep facing this type bad tenants, this one was the worst from the beginning. Others were toward to the end of the lease.

I hope your tenant does not pay January rent, so you can evict him. You need to hire a lawyer that deals with evictions. I don’t know what city you are in, but you should be able to google “ eviction lawyer, your city” and find a flat fee lawyer that will set these bums out for 300-500. Not paying rent is the fast path to getting the sheriff to remove you (tenant). Try getting bad with the sheriff and see how that work out!

Alicewonder of TX, too much drama! This tenant should have been out and served an eviction notice the first time they did not permit access to the unit to do repairs. Stop the drama now.

Alice, step back and take a deep breathe--in fact 2 or 3. It's gonna be all right. First hire an EVICTION specialty lawyer that charges a flat rate like Homer said. Have no further contact after that. Collect anything he writes you,but don't answer back. Let the lawyer do it.

Now sit down and write a Memo For Record (MFR)on the history of this tenant. Complaints, how you responded, dates you coordinated that he didn't meet. And all times you went there, for what reason, who was with you, what happened, do you have witnesses, etc. Write down when the rent was due, how much is owed, what costs you incurred due to his damage.

Everything, in chronological order. Print off all the emails he sent you. Give this, The MFR, along with copies of the bills to the lawyer. Then go do your thing and let the attorney handle it. Make sure the attorney has your cell# and can easily contact you. Everyone goes thru this at least once.

When this is over, tighten up your screening process. Correct due diligence would have found his bad behavior with his former LL. And 5 months is too long to be 'asking' the tenant to go. Next time/next tenant, you will not ask--you will evict at the first sign of such behavior. --108.87.xx.xxx

I will look for a eviction lawyer.

One correction, I have asked the tenants to move out my property in the last five months, I didn't wait for 5 months to ask them.

The tenant also expressed and indicated that they wanted to move out six times in the last five months.

I told him that the false accusation of mold or leaking, they should move out, they plan to get free rent and free medical bill. He already said they had health issue because the mold....etc.

Some people are jerks. Some people just like to create chaos. Somehow this one got past your screening. When ever we see problems we go back to their application for something we missed and try to learn what to do better.

I've had many "Departments" from the City and County side with a tenant making false complaints. Like they have no Hot Water. This property has a Central Water Heater and none of the other 34 tenants complained they were ever without hot water in the last 10 years.

Still the City didn't know how to deal with a situation where the "tenant claims they had no hot water" and the landlord is a "licensed master plumber" with a double water heater system set up so if one fails, the remaining working water heater takes over the full load.

In eviction court I had the Head Plumbing Inspector from The Building and Safety Department testify that my dual water heaters were set up so my tenants would never had been without hot water. The water heaters were in great shape, one was 2 years old and the second one was less than 10 years old. I also had several tenants there to confirm they never ran out of hot water.

I won my eviction case only because I proved I had no hot water issues . --47.156.xx.xx

Alice, the fact that you persevere on this forum, tells me you have what it takes to succeed in this business (or any business.) Don't let the fact that you are not a white six foot male hold you back. My daughter's mother-in-law is a five foot Hmong dynamo, who supervises many employees. She wasn't born in this country, has never been to school. But, her employees know she is in charge!

That fact that you persevere, are very willing to learn, and have shown tremendous growth says to me you will succeed.

There are tenants out there who will appreciate that you keep your houses in good shape, fix things promptly. You just have to figure out how to find them. Brad's suggestion to re read the application (after you get your attorney working on the eviction,) to see what clues were there is excellent.

For me, when I looked back on my worst tenant, I realized that when she was talking to me about the house, she hollered rather rudely to her family that she was on the phone talking to a landlord, and there was a rude exchange of words between her and her family- well that was MY clue. Now, 'How do the persons applying talk to each other and interact with each other ?' is my FIRST screening criteria.

I'll bet that when you look this bad tenant group up on circuit court records, there are probably lots of small claims court cases, and probably some restraining orders. I won't accept a group with that. Tells me they like to use the courts to solve issues, and , if I want my money, I'll probably have to go to court too. Next!

The attorney you went to does not want to handle a LL tenant case as I see by his attitude. Please do as others have suggested and find one that does. You can call the nearest rental complex and tell them you need a recommendation of a LL tenant attorney. Some of them are in business to help tenants under the guise of helping you. Bad residents usually "shoot themselves in the foot" and give you an easy eviction or they skip out.

This one sounds like the type to hunker down and stay until the sheriff puts him in handcuffs.

Did you atty say "stay calm" because he is working on it? Waiting for the res to make a mistake? Keep you from jumping up and down on his couch??

Don't let this guy get under your skin. Just the facts m'am.

File and let him curse to the judge.

Alice, you really must learn how to screen your applcants. Those were not darling reasonable people all of their lives who turned into monsters after they moved into your rentals. They have always been bad people.

You have to talk to the landlord where they are just moving out and to the landlord before him. You also must verify that you are talking to the real landlord and not the applicant's buddy who is pretending to be the landlord.

If you are going to continue to be a landlord, I suggest that you stopping using leases and switch to month to month agreements so that it is easy to get bad tenants out. --174.216.xx.xx

Even though you have an attorney, you may have to appear in court. Otherwise tenant can claim anything. Other option might be give them 30 days to be out (rent free or no judgement) in court, and they will agree. Then at least problem is solved with minimal loss. --108.176.xxx.xxx

I took the advice and contacted an eviction specialty company in town.

I sent the same info, I shown in this forum, but the partner of the company rejected and said

January rent has not received, and they are going to claim the medical bill.etc. I talked their previous property manager today, she just said yes, they will play the same game with my lease. They won $15,000 case from the previous lease and claimed the rodent and medical bill.

Yes, I sent the final note for determination of the lease. They don't care, the male tenant even told me how the eviction process goes in the court.

I was told by that property manger, In texas, if it is not emergency, e.g. flood, fire, if the rent does not pay, the landlord can put the repair on hold. My problem is I do not know what need to repair on my property. Every thing he claimed thus far were not true: roaches, rodent, hot water heater, the furnace, the toilet. I just have not found a roofer give me some input, if it does leak or not. I know it was not, until the tenant sent me the email on 12/18/2017, told me the last three items and said it is not urgent matter.

Then, the roofer could not come due to the wet weather, so now he claimed the mold, the leak, and he has medical issues because that.

Well, I am about to leave town. Don't know who can help me to get this evil tenant move.

I am so sorry for myself and got myself into this situation. When I tell the truth, no one wants the trouble. Another property management said They do not want to get into the middle of the lease, and deal with the trouble tenants.

No, as of today, the rent has not been received.

Here was the roofer responded, and don't want to do it neither.

I talked an attorney over the phone, she said to reject the rent, the bank said I have to close the account. So, in this way the eviction will be dealt with only on no payment.

Then, she will send the three days notice of eviction from the property. Then, there will be court day ...etc.

She said the total cost for her service will be around $2500. The main issue is I do not have anyone to present me as an owner in court, when there is a court day before I come back. And she does not know the details of the issues.

I don't know what to do. Could someone let me know do I have any other choices, the timing is just not right for my time.

Alice in Wonderland, in your situation and having a tenant who is taking advantage of you,I'd pospone any trips or time away from your home base.getting rid of those tenants would be my prime objective and talk to a lawyer face to face and not over the phone. I will handle it when I come back to the State. I wonder what is the purpose to have such an evil tenant in my property. I already experienced many dark sides of the humanbeings in my life.

In my decades landlordshop, I never evict a tenant. I am compassion and want to help the people who are in need. But, I am sure I have my limitation. Espeically after all those insults, and knowing the tenant is playing the same game as they did before, I will take an action to evict them.

Why do people think there are free rent and free money out there?

I understand that not only the tenant owns a wolf, but they are the wolf themselves that I grant them the lease. I "invited" the wolf into this tradegy.

Can anyone tell me how to file the eviction notice to the credit report burea, so it will be shown on the tenant screening?

I am NOT looking forward those expensive and lengthy eviction process. It means the tenant has free rent for many more months. Furthermore, I am afraid that the tenant can simply disconnect any wires in the property; potentional and intentionally destory my property.
