State Specific Question About: FLORIDA (FL)
If the Tenant has not paid rent for 2 month and we had to evict them eventually. What is the right way to handle the security deposit and whether any communication need to be done with the Tenant for security deposit. Thanks

Here in NJ the deposit has to be returned within 30 days. If they damaged the apartment we can deduct money for fixing the damage but we must send the tenant a copy of the bill for the work done to fix the damage they did. Follow your state and local tenant rules, you need to send an accounting statement which details the repairs needed for damages - not wear-n-tear, unpaid rent till the time the sheriff moved them out and you changed the locks - depending on your local rules you may just go with monthly rent if that is how your lease was prepared. Your state and local tenant rules will give you the timing and what happens if they just go away without leaving a new address - in this case you send to the last known address (your unit) and when returned you -DO NOT OPEN- AND SAVE THIS IN TENANT FILE.. --76.188.xxx.xx |

If as you indicated the tenant has been evicted-- your damages letter showing the amount owed, damages and disbursment of the deposit should have gone out in a week or 2. You haven't checked your state laws on this and to be honest you are not prepared. It is discusting to hear of LL's who don't even know the basics of their business. Gives us all a bad name. Sorry but true.
Want success in LL'ing heres a simple rule-- know more about the law than your tenants or they will eat you alive.

MYOB, 90% of landlords own 1-3 homes, and many are "accidental" landlords: inherited, home they couldn't sell, etc. At least Sam/FL is coming here to ask for help. No need to chastise him.

WMH thank you for correcting my thinking. Tenant hasn't paid rent in 2 months plus tenant was EVICTED and just NOW Sam has questions? Sam has come about 4 months to late and as I see it isn't looking to learn but to find excuses for himself.
He evicted so apparently he had some knowledge?
WHM where did you come up with the 90% and 1-3 homes and the accidential LL's? or even the couldn't sell? Maybe you have those documents about that to share or are you just throwing out numbers? never seen that mentioned by Jeffery? --99.103.xxx.xxx |

Well, bottom line is that when you evict in New Jersey and I'm sure in many other states, you enter the amount of rent owed less the security deposit (+ interest). So if the tenant has been evicted, there is no need to do anything else about the Security Deposit. --23.30.xx.xxx |

Yes,our lease is the same, but when we file for eviction for non-payment of rent the court requires us to list the Security Deposit as a credit. If we sued for money damages, I'm sure we would be able to add the costs of damage to the apartment, but so far we have only sought to have people removed. --23.30.xx.xxx |

It depends on what the state law allows for deductions. In NC the first line of acceptable deductions is back rent. Check your state and local laws for security deposits.

The Florida Statue is very clear. 15 days to return SD IF no deductions are to be made to SD. 30 days for deductions to SD. If there are deductions it could exceed the SD but you still have the 30 day to itemizing of deductions and send written notice.
