Since the tenant owe me over $16,000.00 back owed this year in the state of Indiana and because the small claims do not apply because it is over $16,000.00 this means going to surpreme court right?

And another question is going through surpreme court this means how long does it take? example one month or 6 months to finish it to begin the garnish from her payroll or whatever... Based on your line of questions you are about 15k past the get a lawyer answer, have you ever handled eviction court? Prolly not - of course they will be notified - any court has to have service on the tenant, so going back to this amount- what happened to the manager who let this happen, you may also want them to be named in this for negligence. You need an eviction service lawyer for this project, no other lawyer understands the timeline in the housing business, the crminal/traffic/murder lawyers are used to having a trial go 16-36 months and they will have hourly fees for all the motions, case review and soon, find a eviction service legal team and spend 350-500 to get this case under control, the manager apparently had no clue what she/he was doing to accrue 16k in damages, my all time high was 9k from flooding a 2 story house requiring new hardwood floors - a month before this the house passed a city inspection and a housing authority inspection, so I asked for repayment in 45 days, the judge agreed with me personally but could not rule this way. --76.188.xxx.xx

What part of IN? How did the balance get to $16k? Do you believe you can garnish your tenant for the full $16k?

Get an attorney. You can consult with them whether the added time and expense of circuit or superior court is worth it rather than limiting your claim to the small claims limit. A small claims eviction takes 1-2 months. Getting a damage judgment is another 1-3 months. Garnishing takes another 1-3 months. I wouldn't be expecting any garnishment checks to be coming in until late next year. If you take it out of small claims, it will take longer.

Yes, your tenant will be served with a notice of claim after you file.

If you go to small claims, you should be able to get a flat fee eviction attorney for less than $500. --73.102.xxx.xx

go for an amount that stays in local court. you have several problems. 1st is you have no idea about the process. 2nd for this large an amount when you go to superior court you'll need an attorney. 3 with this large an amount they wont pay and you'll be stuck with attorney fees. 4.th and a biggie-- with this large an amount even if you get the judgement they will look to declare B/K. Must be very careful when sueing that you keep it in a range where they don't claim B/K cause your not going to get anything from that court.

Bottom line 16K debt- 10K for atty and court fees-

Tenant: answer court- free - declare B/K $3K and there out from ALL their debts. The 3K is paid in installments. --99.103.xxx.xxx

Get started searching for an attorney to help you get possession back. That is the first step. After you have possession and clean, repair, rerent, then you can work on collections. If you are counting on a wage garnishment to bring in all this money, you could be very disappointed. Most my garnishments take a year or two to start bringing anything in and often it is less than $100/month.

The 1099-C is an option to forgive the debt and report it to the IRS. You are agreeing to never pursue this debt again. The IRS considers this income to your tenant and they would have to pay income taxes on it depending on their tax situation. The 1099-C does not change your ability to write off the loss. If you are a cash basis filer (most landlords) you never reported rent income you didn't receive, so there is nothing to write off. If you are accrual basis, you could write off the unpaid rent balance when you decide it is not collectible, but you would have already included the unpaid rent as taxable income. There is no tax advantage to you for a 1099-C.

Again, get an attorney to help you with the possession action so you can get your property back and stop the bleeding.

If you ran a credit report you would know if in the past 5 years BK was declared. Second they refile from one bk to another 13 to 11 to 7. In the mean time your stuck.

We pay for a program to check BK thats used even after they get in our property's. Heres why-- even if you don't know they declared BK and you go to evict-- you could be held in contempt of BK court $5K fine. Also it gives you a heads up if someone has filed BK to get the stay lifted.

We had a tenant who gave the BK court the wrong mailing address for the company so we never got official notification of BK. She slipped one day and mentioned court so we checked sure enough she filed it. We had to get our atty to file with the court to correct it. Its outrageous. If you don't get the stay lifted and you filed the dispo in local court you finally get in front of judge and tenant says judge I'm in bankruptcy-- now you get to start all over and that means BK court first. Stay is lifted then you can file with dispo cort. --99.103.xxx.xxx

Now I am thinking about getting someone from Remax agent who does all the screenings A to Z and when one tenant we approved to move in the Remax agent will collect first month for their service after that all rent monthly payments goes to me... You need this site to help you find tenants-- the right way. read what these people are saying about tenants and screening for example. Get the application from here for your prospects- use the credit app for screening.

You have a lot to learn and quickly. Just using the left tab here read everything you can concerning rentals-- you don't need things like "stump grinding" at least not yet. You can read more than 30 days worth of posts and LEARN. --99.103.xxx.xxx

Use the realtor to find a barber shop, or yourself a house, they do not work well with other peoples rentals. After you get a haircut begin to understand the rental business by download and printing your local and state tenant laws, place them into a 3ring binder - flip over for the state rules so you do net get them mixed up. If you were going to play a card game you would want to know the rules - right? In this business the rules is simply a starting place, you will visit housing court at least 20 times and at least 2 landlord groups close to your area before you open for business again or you will find yourself in a position like this very quickly, would you gamble your house in a card game you did not understand? Brad, Yes please share with me all you know and guidance. Appreciate it. Noblesvile, Indiana zipcode 46060. Hamilton County. After tenant moved in the house later, The tenant said she is cancer patient. I did not know how to react so I felt bad. She has not paid any rent payments. My mother passed away from cancer one year ago. I never told tenant anything about my mother. I was with my mother 24/7 did the clean, cook, transpiration to Doctor, store, drug store, etc. My Daddy passed away from first and last heart attack (massive) unexpected. He died 63 yr old. My mother died 69 yr old. My mother’s health was fast and unexpected too quickly. So I feel sooo Orphan … I should have evicted tenant on first month but I did not. She said she promise to pay and also said she is cancer patient. Now I am ready and moving on and forward eventho I miss my mother so much. It will be hard for me as Christmas is approaching thinking about my mother not being here in South Carolina. The next tenant will be evicted on first missed rental payment for sure. Everybody please easy on me. Smile. Anyway Now, I am stuck with bad HVAC “gaspack” that needs to replace I was hoping that I will get some money from rental payment to cover the cost of the HVAC replacement but it is not happening so I am using portable heater. I found repairman only cost 3K for everything (upfront in cash). I will try to think figure out. I still do need guidance and point direction and share info. I appreciate it so much. Who has the keys? that is the key to whether you file eviction (unlawful detainer), if keys are still in possession so is this tenant - if they keys came back then switch locks before taking any photos of the damages (be sure to document the old, repair lock and eventually the new key codes - you will want to have this for court) or the tenant could claim damage done after departure, someone will appear in court stating they had extra key to water the flowers or whatever and your claim can drop to 1600bux... --76.188.xxx.xx

And also I am wondering eventho I do not have to do the filing eviction because the tenant has moved out and gave back house key but I cannot help thinking about all other landlords because I do not want other landlords to go through like I did... I have replied email back to you but I have not hear back from you yet maybe it went to your junk folder. please check there. Also thank you for your phone number but when I called the number the announcements went on for almost 8 minutes long.
