I was at a house doing a repair in the backyard. I noticed a bunch of stone materials stacked up. I didn't know what they were for.

Later tenant texted and asked if they could build a fire pit in the backyard. I replied "no".

Then I realized they had gone ahead and bought all the materials for it before asking me if it was okay.

Now-gone tenants build a well-done fire pit with marble and such. It was beautiful. They build ROARING fires in it almost every night almost year round. Reading on Facebook about their fire scare stories...When they moved / were asked to eventually leave, I immediately had the fire pit torn out. Another tenant haphazardly tried to build it back, I screamed bloody murder and no more fire pits EVER.

No, nothing ever happened. But the possibilities of too much beer and wine and fire are scary. --173.22.xx.xx

I would say no since I have a lot pine trees in the yards. There is an old lady firebug who lives behind me with no container for her yard waste fires so I leave a hose out just in case. Why invite a tragedy on a tinder dry night. No I would not feel bad. Perhaps they can return the items or sell them on Craig's List. --73.33.xxx.xxx

I'd feel bad if they burned my property to the ground.

I would not feel bad about saying no to a fire pit.

But we spend a lot of the year in burn bans.....like right now. --63.245.xxx.xx

They wouldn't have asked you if you hadn't seen it. They probably figured they should ask since you saw it.

This should be addressed in the rules and regs section of your lease. --74.37.x.xxx

This is an easy one. There was a case here in which a tenant put in a fire pit and a drunken friend fell into it during a social event. The friend sued the landlord because of course the tenant had no assets and little insurance. Under a concept known as occupier's liability the landlord was found to be responsible for the fire pit and for the injuries suffered by the tenant's friend. a prominent lawyer here wrote an article about it. The advice was to be well insured and to absolutely prohibit firepits and remove any and all firepits found on the property - immediately. There should be a clause in your lease about this. --76.69.xx.xxx

This is the reason all of my INSIDE house fireplaces have plywood blocking the fire box. No inside fires in fireplaces,..you remove the plywood and you are evicted. Also, no barbecue grills used under covered porches. --68.63.xxx.xxx

If they were good tenants, yes I would feel bad.

But you have a responsibility to do what is best for the property. I see the property as the golden goose. Only by protecting the property, can it continue to provide assets for you.

And.....who will feel badly for you when the embers from that fire pit sets the neighbours house on fire.

Tenants should have asked....they didnt.....dont make their problem yours....like most of us you probably already have enough of your own problems. --70.30.xx.xxx

J,

Great post! Just added a new firepit clause to my lease!

It seems Lowes and Menards alternate which week the split face landscaping blocks are on sale - perfect for making a fire pit.

We dismantle them and stack the blocks at a storage garage. I just counted over 100!

I took 25 to church to use as I taught about Nehemiah rebuilding the wall around Jerusalem. The kids had a great time trying to carry them in and stack them.

Pet door, aka holes in my door because they are too lazy to open it?

Then come draft, racoons, cats....

Will they be paying you in advance for a new door and labor to replace it when they move out for the next tenants who doesn't want or need it?

Did you know some theive can climb through those for big dogs? Or send some one small who can?

Does that mean doggy will be outside when they are not home barking to the Joy of the neighborhood?

Should not have a dog if can not even open the door for him.

Firepit is disaster waiting to happen. Some cities it's against city code too.

Fire and tenants don't mix.

If the rental doesn't meet their needs live with it or find a better place that will be more suitable for their special requirements or accomodations.

That's what I suggest. Amazing how they live without whatever they're hoping I'll give in to.

I had a guy once plan on a pit on the tar drive way.... didn't believe it's flammable even though home Depot said so... Time to look for a new home for his special specific requirements. Suddenly didn't want a pit anymore.. amazing...

Growing up in Northern Ireland and Listening to the wild stories told around that open fire in the kitchen,a fire pit out in the yard wouldn't bother me too much.In fact it would go good in weather like this, take the chill out of the air, maybe even get a couple of bags of marshmallows, the big ones and some hot dogs, without the buns. J if you still have a problem with the extra brick, you could donate them to the bozo on fifth avenue for that imaginary wall he's talking about on the Texas border. Or send them up here with some of our friends who take a trip down your way in January for a couple of weeks, whichever is easier?
