I have 2 other houses that had mandatory evacuation. The tenants stayed with friends and are now back in. No complaints.

Do I need to refund the rent for that time period? They have not asked me to do so. And obviously it's not my fault there were severe wildfires.

They were very cooperative.

I believe renters insurance covers additional living expenses for an evacuation ordered by the local government. If they stayed with friends, and haven't said anything to you, they probably understand this was an emergency situation and don't expect any compensation. If they had to get hotels, they may have filed a claim with their renters insurance, but staying with friends for a few days, they probably didn't. If they ask you about it, you can refer them to the renters insurance. --73.102.xxx.xx

This question was discussed both in the media and addressed by several mayors in storm struck areas this past fall.

The answers were vague and the decisions were split with many referencing the tenants renters insurance but I would think that is only applicable if your lease required renter's insurance.

Your property insurance as a LL will also cover you for lost rent. The question there could be if if it would be subject to meeting your deductible.

My personal feeling is that most renter's really can't afford the added expenses. If they were really solid tenants and we were only talking about a few days to a week I would probably give them a credit if they requested it. --71.75.xx.xx

I wouldn’t offer a credit. The required evacuation was out of your control. Your overhead on the property will not be adjusted by your mortgage holder, tax collector, etc., so I would not feel obligated to offer any credit. --107.77.xx.xx

Lots of my tenants were in evacuation area during our recent hurricane. Nobody asked to be reimbursed for anything, including the fact most were without power for a week after it passed. Acts of God are not expected to be a landlord's responsibility. We had enough to deal with cleaning up and making repairs after it passed. Everyone did their part to include cleaning up their own yards without complaint. --173.170.xxx.xxx

I give gift cards to Fred Meyers because there is housewares, garden, pharmacy, groceries, and gasoline. I figure the tenants can find something to spend the card on. --174.216.xx.xxx

Great and timely question!

I'm with Brian. The evac order included the entire community and affected everyone equally. Theoretically the safety officials forced them out and should reimburse their rent. (not hating, just trying to think this thru)

They DID still have legal "possession" of the home and their belongings were still stored there.

BUT...

This is a FANTASTIC opportunity to promote how great your company is! Be the hero in time of need! I AM in favor of gift cards for a nice steak for the extra cleanup and cooperation. (gift giving is best when it's a luxury item, not essentials like gas or WalMart. No one says "Wow! I got a great gas card!" But they do say "You won't BELIEVE the awesome steak I got for FREE!"

I don't like altering the rent - just opens the door for other complaints and discounts.

My lease is clear: some repairs may limit the use of the home. Management does not provide alternate housing.
