You mean rights or responsibilities?

I try to fix things in 3 stages.

I try to get it done myself first, then I'll ask a handyman to fix it. If those 2 fail, I just call the pros.

If you've tried to fix the issue and it still exists, I'd say it's your responsibility. (In most cases.)

Termites. Carpenter bees, carpenter ants.

If it's spiders, sugar ants, house flys, make them deal with it.

Fleas. I'd make them pay.

Spraying does not work where integrated pest control does. Three elements for survival are food, water along warm place to live. First chalk all the cracks in the baseboards, kitchen cupboards then insulation where pipes enter floors or walls. Put bleach in the defrost pan of the fridge so there is no water supply. Eliminate food supply by thoroughly cleaning behind fridge, stove then making all the garbage is taken out. Max force or Combat get around the perimeters of the rooms. Sticky traps around the perimeters of a room traps out some of the roaches. Over a period a few weeks the roach population will start to go down as there is no water, food or a warm place to live. The gel only works if the food supply is eliminated. Putting anything outside on a cold day or night the roaches will make run for it. --184.147.xx.xxx

Once a tenant has voiced a pest problem, it is the landlords responsibility to resolve things in a very timely manner. Days not weeks. It is also illegal in some City's for a "landlord" to spray chemicals without first giving notice to all tenants so they can protect their children and pets from exposure!

If a landlord things they can handle things on their own and make a good faith effort to eliminate the pest problem, but FAIL -- then it's the time to call in the experts. You need to have PROOF that the Landlord contracted in a timely manner to rid the property of Pests......Otherwise tenants, Housing, the City, Health Department and others have means to penalize the owner/landlord.

If the pest were caused by tenants poor housekeeping, then an internal inspection is warranted. Then specific written instruction must be given to the tenant to clean up and the landlord must follow up with another inspection to confirm things have been taken care of, and, the pest control people may need to come back and reset traps, bait and other extermination means.

As others have said much depends on the type of -bug-, for instance bed bugs require a lot of occupant interaction - clothing needs to be stored in tubs after dryer time, if tenant declines to do their part have them sign a release - good pest control outfits have this to protect them and you should too. Mice, ants, roaches are picnic bugs and housekeeping is needed to keep them under control, I give out a few doses of stick traps cause they are cheap and most tenants do not want to deal with snap traps, and our court likes that I go above what the law requires. If the unit is in a multi-bldg you need to seal where electrical and plumbing comes thru the walls to help keep bugs under control of the tenant - spray foam is a cost effective way to seal the openings - roaches use water pipes like a highway system from unit to unit. --76.188.xxx.xx

My lease has a clause that the house is free of bedbugs at move in and the tenant will be responsible to remove any bedbugs they bring in.

I have only ever had one tenant complain of bedbugs, they tried to say the bugs were there before they moved in, but they didn't report them until several months into the lease. The tenant hired an exterminator who took care of the problem. I did get a letter from the health department after the exterminator had done the treatment. I think the tenant called the health department and was told to take care of it themselves. If my tenant had refused to hire the exterminator, I would have had to in order to keep the unit habitable, but the tenant would have been responsible for the cost of treatment.

There is some variation in state and local laws on this, so check yours. --73.102.xxx.xx
