Tenant agrees to give up certain legal rights as provided by the LANDLORD and TENANT ACT OF 1951. No notice will be required to be given by Landlord and Tenant to leave and give up the leased property. Tenant will be asked to leave the leased property without notice under any of the following conditions.

1) Tenant does not leave the property at the end of the lease term.

2) Tenant breaks any of the terms and conditions of the lease.

3) Tenant fails, upon demand, to make all rent and other payments when due.

David, in Pa, we have a section to check on the filing paperwork for eviction. We can check that notice was served or no notice is required in the lease. You'll have to see if your state allows a waiver at all.

I had a judge's secretary tell me I had to give notice and I told her no I didn't. She looked at me like I had 2 heads and I showed her right on her own paperwork where I could select that no notice was required.

She said she worked there 20 years and didn't no that was on there. --50.107.xxx.xxx

As Don points out you must be aware of local rules and courtroom observations, I have never had anything in PA however my big city has a large housing court docket, after the housing market tumble late 2000's the court got tired of complaints from both parties about slow proof of service and adopted fedex photo delivery acceptable proof of service - so I use it also, no more waiting 3 weeks for the yellow slip taken to the post office and a failure of service. --76.188.xxx.xx

We are allowed a waiver of notice and have that clause in our lease. However, that waiver doesn't shorten the time frame for filing. Here we must wait 10 days from the due date and can file on day 11. I do know that some states that allow the waiver have a "gotcha" clause that says that if you do send a notice then then you must meet the standards of the notice both in the wording and proof of service. As many others have stated you need to check both state and local laws and local customs.

Since we do have the waiver clause we do not send P and Q notices but we are allowed to send reminders that we have not received their rent and remind them that a late fee will be added on the 6th. --71.75.xx.xx

29. NOTICE OF VIOLATION

If Tenant violates (breaks) this Lease by failing to pay

rent or other charges to Landlord in full on time, then

Landlord must give Tenant a five (5) day NOTICE TO

QUIT (also called an EVICTION NOTICE) before taking

legal action against Tenant. The NOTICE must be given

to Tenant personally, or it can be posted on the Rental

Unit, or it can be served as otherwise allowed by law. The

NOTICE means that if the rent and all other amounts due

are not paid in full within five (5) days, then Landlord can

file a complaint against Tenant in court to: (1) collect the

unpaid rent and all other amounts due; and/or (2) remove

Tenant, Tenant¼s family and guests from the Rental Unit.

If Tenant pays the full amount due within the five (5) days,

then Landlord cannot file the complaint.

If Tenant, Tenant¼s family or guests violate (break) this

Lease in any other way, Tenant gives up the right to

receive a NOTICE TO QUIT (EVICTION NOTICE). This

means that Landlord can file a complaint against Tenant

in court to remove Tenant, Tenant¼s family and guests
