Our problem tenant has been calling wanting to work out something so they can stay. My husband went over to talk to him & stress to him his last chance to get trash removed from property & collect what money he had.

Seems he signed his pay check over to us, and a few dollars & coins, & that was for LAST month. We will still have this month to deal with, however, I am collecting late charges now (had cut him some slack 1st couple of times but no more). History: four year tenant, wife left him and his job closed down. So he is struggling for sure, as a cook in a dead end job but with no skills he doesn't have many options.

Anyway, trying to make it through Christmas, (our personal choice) We only have a $300.00 deposit so no room to play with, rent is $525.00 a month with a 25.00 late fee.

The "First" was taking a man's paycheck 190.09. SAD --71.51.xxx.xxx

I advise giving him a deadline to move. If he doesn't, evict. He's not going to catch up. You are losing money every day. Being nice won't get you paid. Keep in mind that this is a business arrangement, and he isn't fulfilling his part. Unless you want to let him live there for free, this is the only option. --134.179.xxx.xxx

I agree with Robert. It will only get worse. You're actually hurting him by allowing him to stay. Most people don't make better choices or solve their own problems until they are forced to. Don't let his problems become your problems. He can't afford the place. --173.170.xxx.xxx

He can live cheaper. Perhaps renting a room in someone's home. You are not doing him any favors by allowing him to stay. Ask him to leave on his own, give him back the $300... Like cash for keys. You'll be glad to clean it up and re Rent for more. Merry Christmas. --66.87.xx.xx

Did just remember I had one Judge 15+ years ago in the western part of the state. He would only allow a 25.00 late fee, no matter what was normal in the rest of the state.

And no matter what the lease said. And of course not worth arguing with the Judge over a minor item. If you have to see him often. --172.74.xxx.xxx

In out area, both St Vincent De Paul and other area churches will give emergency rental assistance. Tenant has to bring in their 3 day POQ notice. We had one tenant do this. The church called us, had us agree to waive the late fee, and mailed the rent directly to us.

The next month the tenant left voluntarily. He said that "having to go the churches and beg for charity was the hardest thing he ever had to do" -- but we was fine expecting us to give him free rent! --98.146.xxx.xx

What plenty said. Encourage him to rent a room and give him his security deposit. The only problem is that he must have spent a lot of money for his goods and it's painful to lose them. I have two tenants clinging to junk cars. They are paid up on rent though. --73.33.xxx.xxx

Is anything ever that simple? He has been allowing his wife's sister & her baby to live there with him. Evidently they are in a relationship now so he is trying to hold onto it because of that. I sent another 5 day pay or quit notice today for December, since he had paid all of November, I have to start over.

BTW, sister-in-law/GF is NOT on the lease but has been living there long enough to claim residence. She was working but quit or got fired. So she is no help. --71.51.xxx.xxx
