Need a little assistance.

Got a couple that has rented from us for 16 months; one wants off the lease and the other wants to stay. The one staying is qualified and makes enough money to pay the monthly rent.

Is there a form that I can have the other tenant sign that removes them from the lease without going through signing a whole new lease.

Short answer is no such paper, let the lease expire- assess damages and get paid for current damages this month before you lose as the existing one will say other one problem, don't even think about dividing the deposit until the damages are corrected. Once the lease has expired then you make a new lease for the one and don't forget the deposit then has to be restored in full - which is double rent value for my places. --76.188.xxx.xx

My general policy is that no one gets removed until possession is returned unless there is concern about safety or my property. If I were to remove someone then I would want a document signed from the departing tenant giving any claim to the security deposit to the remaining tenant and then sign a new lease with the remaining tenant. --166.137.xxx.xxx

Our lease has a paragraph for removal-- must tender 600.00 lease cancel fee and one remaining must be in agreement. Then we:

redo credit check on one staying. One leaving signs, with witness, that they have relinquished any right or claim to the deposit. One staying -- if not denied outright for renewal will need to tender an additional deposit of 20% above what's on file. (reason -- lease was originally approved with 2 incomes as guarantee now it's only one and I need more piece of mind)

Current resident must also stipulate they are accepting the condition of the property as the condition of record as of such and such date and the move in inspection from original lease will control. --99.103.xxx.xxx

My lease is clear: with management's approval the res can pay the Early Release Fee and be released from the lease.

(a fee calculated as 2 x the rent amount)

They usually pay it because they want OUT!

Our approval comes if the remaining res can handle the rent.

Brings in cash!
