State Specific Question About: ILLINOIS (IL) HAS ANYONE EVER CHALLENGE CITY ORDINANCES?

WHAT WILL I NEED TO DO TO CHALLENGE A CITY ORDINANCE OF INSPECTIONS.

CITY OF MARKHAM IS IMPLEMENTING REGISTRATION AND INSPECTIONS WITH A COST OF 150 EACH UNIT. PLUS INSPECTIONS OF ALL THE HOUSES (REPAIRS )AND EACH HOUSE YOU HAVE TO HAVE CERTS FOR ROOF FURNACE HOT WATER TANK AND ELECTRICAL. WOW UNBELIEVABLE COST WHICH IS RIDICULOUS.

Yes, we have that here in my town. A local lawyer/investor let that go but went after the town when they tried to tell everyone that tenants could not park on the street and no one was allowed to add any driveways. They were having a war with the local college to keep out students. College built a lot of dorms and the town gets no business from the students since they built stores also and call it Campus Town. Townfolk go there to buy too and lessen the income of the local stores. College students tend not to vote so the politicians wanted more low income folk who tend to vote their way. Crime is up and my rents are being depressed by that. But that's what they want all over the country if folks are dumb enough to vote for them. Just got one as governor. --73.33.xxx.xxx

Are they requiring these inspections of all houses or just rentals?

If it is just rentals, I think some landlords have stated that their states have ruled the inspection of just rentals and not personal homes as unconstitutional. --99.165.xx.xxx

They are rentals. I remember reading an article on Mr. Landlord about the same issue. Just wanted to figure out my next step. This city just implemented this ordinance this year and its a doozie. $75 registration fee. $150 inspection fees. The cost of the repairs in addition to getting everything certified. Last house they inspected I was out $2800. With 7 houses Im thinking now way am I going to go thru with this every year. Something needs to be done. So I am looking for my next step in challenging the village.

Two landlord organizations joined together to fight the City of Pittsburgh which tried to implement a similar registration and inspection fee. State of PA allows registration and inspection fees as long as they only cover the cost of the program, not allowed to use as a tax revenue stream. They proved the city was charging above the cost of the program. I believe they also proved that by targeting only rentals and not owner occupied was not uniform. These two landlord organizations had hundreds of members, a number a real estate lawyers and some very large landlords that stood to loose a large amount of money. As such they were able to afford the fight including appeals.

Having noted all that - many small towns in PA have registration and inspection laws. No deep pockets to afford the fight so stuck with paying with no recourse. --72.95.xxx.xx

This is nothing to do with inspections which is cash grab to get revenue what they believe the rich landlords. One city in Hamilton, Ontario the landlord association has to constantly fight the city from passing similar legislation. As a individual it is impossible to fight but as a landlords group it is possible to repeal or change this nightmare. I've gone against my City's ordinances many times over the last 20 years. My victories, successes and wins came at a "cost", almost never getting my money back, UNLESS after proving myself in the "Hearing", I'd end up having to sue for a "refund" or "Funds" in Superior or Small claims court.

One time when I was very so right, the city decided to be punitive and then inspect 3 more properties, all large multi-family units, in the same time frame so that there was no way I could pass and/or correct violations in that tight window and would be forced to pay fines and/or go to jail....

Post notices and advertise to other landlords the rent must go up due to silly city rules, prepare a flyer and leave several at city court, city hall, grocery stores - anyone who rents will now be faced with a unplanned increase due to this pending city rule, of course if you were active in city meetings you would have heard a little kibble about this and could gather other landlords and tenants both to flood council meetings and let them know this is not a welcome rent increase. --76.188.xxx.xx

To those who claim inspections are a safety issue, they are not. If the government was interested in safety, they would demand to inspect the rundown, owner occupied sfh next to one of my rentals, but they don't. That darn constitution applies but not Tenants and Landlords. Also, if an inspector misses an electrical violation and the property burns down, the inspector and the city are not liable. When I tried to pull a permit in the past for a rental property, I was told I could not because I was not living there... what difference does it make who does the work if it is going to be inspected anyway? --174.229.x.xx

No worries about Gun Laws here - Heck we dont even have seat belt laws or motorcycle helmet laws - Live free or die Baby !!! We have one of the largest legislatures in the world (400) - they all get paid $100 a year for the few weeks they work on the 2 year budget. True citizen legislature ...and we also still have town hall meetings. One of the highest income states too! lowest unemployment also at 2.7% . Once you get all the code related problems fixed like the $2,800 you just dropped, it's not that bad. My license is $50 per unit and the inspection fees for a Certificate of Occupancy is $50. The fire inspection fee is also $50 per unit. I figure it as a way to get a look inside at least once a year with the fire inspections. Then I can make tenants cooperate if they have removed alarms or have done something else stupid like starting to hoard things and having wires all over the place. Take it off your taxes. Since I am not at all scary looking, the inspectors can be used as a threat if I see something going bad. --73.33.xxx.xxx
