State Specific Question About: INDIANA (IN)
In possession hearing of an eviction, tenant informed judge that I told her she can voluntarily move or I can evict, which will potentially harm her rental history and credit. Judge said that is not true because if she leaves before possession date, the case does not get ruled as an "eviction." Judge claims that would not impact her credit or rental history. My understanding is that a rental history search on the tenant will show ANY eviction filings, regardless if the court rules, or not (she moves out before possession date). When filed, a case number is assigned and that would become public record, correct? Or, does it not show on rental history/eviction databases until there is a court ruling? --108.251.xx.xxx |

Which court are you in? I have hear this from one of my judges. I don't understand why the judge says that, but it does get stamped on the judgment form. I updated my rental criteria to clarify that poor rental history includes a writ for possession, even if it is "not an eviction". Credit bureaus don't usually record evictions anyways, so there isn't much effect there. I don't know how eviction reporting services are handling it. It still shows up the same in the online court record search, sometimes the court staff note the "not an eviction" line in the case history.
I wouldn't mind if it were used sparingly in strange situations, but it seems to be given to any tenant that shows up and says they didn't pay. --73.102.xxx.xx |

I think I found your case (may not want to use your full name on this forum). Different court than I had heard this in before, but the same wording. It looks like there is a counter claim regarding bedbugs and other issues. I found it, so other property managers should also be able to find it and contact you to get your side of the story before renting to your former tenant. I have always understood that public records are picked up on credit reports. How much them impact them, I have no idea. So if she moves out and a formal judgment isn't issued, the judge may be correct.
Ask an attorney who specialized in credit issues. As for me, I don't care. I just want to get paid. If they owe money I turn it over to my collectors, and that does go to all 3 major credit bureaus. --173.19.xx.xxx |

Hello fellow Hoosier!
If a lawsuit was filed a case number will show on court records. It will show what was filed and a remark about the decision.. Online courts records do not show much, just a brief word or two.
In my local coirt if someone moves out before the possession hearing and the court is notified, the record usually says something like "tenant has vacated" or "parties reached a decision".
Credit reports do not show this info.
CRs only pick up the final judgment amount. But I've been told CRs are. O longer gathering info from small claims court so this might not show on a CR.
Eviction reports are another animal, usually data gathered by a service provider, for an extra fee. Not all databases are complete. One company only ahows evictions their member clients has bothered to report to them.
If you are the LL don't worry about it showing. Handle your case and move on. Your filing will show and proper LLs will see it.
