I have a prospect who has left an abusive relationship, and is able to get government assistance with regard to getting a new apartment.
I just received an e-mail from the agency and they want a copy of an unsigned lease.
My answer: "Sorry, we don't do that."
I'm just not comfortable with that.
Any opinions?

First, the agency doesn't sign the lease. Second, I don't know of any landlords who send blank leases to tenants prior to signing.

I send an email of my rental agreement before signing. As Nicole said, you want to know what is in a legal agreement before signing it. The tenant should have plenty of time to read it thoroughly, to know what they are signing. If there is something they object to, I want them to know right away and not back out during the signing.
If the agency is giving assistance (and that is needed to pay the rent) of course they want to see the lease. It is the legal document that tells how long the tenant is obligated to rent, how much the rent is, whether it includes utilities, etc. The lease after signed is usable in our area for proof of residency too. --96.236.xx.xx |

The problem is that sending an unsigned lease gives them time to go over every sentence with a fine tooth comb, questioning a lot of the stuff there.

I still don't get the problem. If you tell them up front the lease stands as is with no negotiation and no changes there is nothing "to deal with" other than one reiteration of "no changes" if they ask. My only concern is giving them 24 hours to accept so they don’t leave me hanging and I miss out on someone else renting it while they ponder.

I too send out a copy of the unsigned lease with the "congratulations, you're approved!" email. My word processor (Open Office, free, download online, creates Word docs and PDFs) has a watermark feature so the word "DRAFT" is stamped in 3 inch high letters at a 45 degree angle corner to corner.
If they mention even one "can we change...?" I say, "No." UNLESS, I can find a way to profit from it.
Tenant: "Can we have a screen door?"
Me: "Certainly, rent will be the normal rate +$25 per month and our contractor will install in the early Spring"
I don't normally do screen doors, but it's Fall now...this gives me 5 months of rent to cover the cost of installing a door...after that the +$25/ month is all gravy.
Simple. Elegant. Effective.
I would NEVER sign a document I didn't have time to review thoroughly. That would be (hmm...how do I say this nicely???)...CRAZY! ;-)

When a tenant cant be bothered to read the lease or ask questions it implies to me they wont follow it anyway.

This was a very rare request. I figure, hey, why not. I watermarked "sample on each page and sent it to her. She sent me a her signed copy of the holding agreement, as well as the security deposit.
Without a security deposit I would have kept the unit on the market.
In response to your question, I'd rather be right AND rich. They aren't mutually exclusive.

Jeff, not sure if you've been around long, but most of us here don't collect "security deposits" to hold units. Rather, we collect Holding Fees. Consider altering the language of your holding agreement going forward, unless you don't mind giving refunds to folks who back out at the last minute.
Btw, I know some folks who use try to get around this by using the term "nonrefundable deposit." I don't know how your judge would rule on this, but in my town deposits are refundable, by definition, unless I can PROVE I had a loss. So I'd have to show I found another willing, ready, and able renter who had money in hand to give me but who then walked away solely because I had promised the unit to someone else. Difficult to prove this. The same judge has no problem letting me charge a FEE for the time I hold a place vacant. Words, words, words... --173.19.xx.xxx |

Sid, as I have said, I have been doing this for 20 years.
I collect holding deposits (like earnest money) that convert to security deposits.
They sign an agreement stating that it's non-refundable if they don't back out. The terms of the rental agreement are spelled out, as is the requirement to obtainain renter;s insurance prior to taking possession. (They name the appropriate LLC as an additional interest).

I've done it a couple times when someone asked. I send them a PDF so that they can't edit the lease, just look at it.
I had someone point an error in my lease once, so it actually had a positive effect.

Not me! I am happy to negotiate the terms of the lease. I might be unlikely to change any of the terms, but I am happy to discuss/negotiate.

A lot of charity organizations want a copy of the lease to process the paperwork. They probably want an unsigned copy to review to make sure its within their metrics. Ie its not a 4k sf beachfront house, its not fraud ie your a real company/person with a real property to rent, etc. I had the Red Cross paying one of my tenants rent for a bit and they wanted a copy of the lease.

Thanks, Chris. This is a weird deal. The prospect makes $60K, but has no money, and a 540 credit score due to medical problems. But she seems smart and is personable. She had a big problem with an abusive boyfriend, a protective order, etc.
This is a very hard time of the year to find tenants, even in Denver. In addition, no one wants to be evicted, as it is almost impossible to find a place with that on your record.
She is alone is responsible for the rent and will be held to the same standard - i.e. rent is late if received after 5:00 PM on the first. 3-day notice is served the next morning.
I am rolling the dice here, which is something that I don't normally do.

BTW, I've had someone on government aid default with impunity. What kind of a program? ASK, what will happen if she defaults (embezzling the funds she gets as in my case)??
The police put my name on some list and you wouldn't believe the sob stories I got to hear. Woman with kids in some motel. No car, gotta do the taxi service for a showing and - of course - no money or a prospect of getting money in future.
This might just work out. Or would this entail S8 type of inspections with the potential for a nightmare unfolding due to peeling paint or not strapped down HWH?

Here in Wisconsin if a copy of lease is given to anyone it needs to be marked as for inspection ONLY. Otherwise they can argue that the landlord has entered into a rental agreement. Personally, when they submit an application and are approved to rent from me, is when they get a copy of the lease for review and signature. They can choose at that time to read it and sign it. OR NOT. We've spent years and dollars finetuning our 10 page lease with attorney input....I'm not just handing it out to every Tom, Dick and Harry to steal all my good ideas from. :-) --71.95.xx.xx |
