I want to sell my house. The tenant refuses to vacate the property. Can i evict hem even though he continues to pay the rent?

No way. You must sell with the tenant and lease in place or offer to buy the tenant out to get them to move. If you've already soured the relationship by demanding they move when they have a valid lease, your buyout amount is going to be pretty large... --67.172.xxx.xxx |

if month to month, give them notice and sell when they're out
if you're in the middle of an annual lease, offer them $$$ to go
sell the property with them in place (unless it's only to be sold to an investor, you'll get less $$$ this way) --72.95.xx.xxx |

It depends on what your lease says.
If it says you have the right to terminate with proper notice and then they don't leave - an eviction is in order.
If the lease renews itself in annual terms - you can't just ask the tenant to leave without hooking the person up. --24.101.xxx.xxx |

Rule of thumb: A lease survives a sale. --174.51.xxx.xx |
