In August I told my tenant that her lease would expire Sept 30 and that I would not be renewing the lease. She was disappointed and a few days later she said she secured a place but it would not be ready until a few days into October. She asked for a few more days and I agreed. On October 12 I asked when she would be moving and this is when she told me she was purchasing a property and waiting for a closing. To day I asked her again when she would move and give up possession and there was no response. What would you do to get possession of your property????She was a good tenant, but I suspect that the closing is not solid and will fail or drag on for weeks. --99.62.xxx.xxx

I think just give an official 30-day notice, if she moves within 30 days, great. If not, you can evict.

If your year lease is up then unless otherwise stated in your lease it converted to a month to month. If you want to terminate the month to month lease you have to provide one rental term notice, one month. I believe Kurt is correct, the 30 day notice form is correct. If she does not move then you file for a court hearing. The 7 day pay or quit notice is only if she is not paying rent and then if she pays, she stays. --76.220.xxx.xxx

Mary,

Why do you want her out? Is she not paying?

Her house may NEVER close. Also it might be an excuse. I've had people say they were buying a house, they did not understand about loans and closings, they were simply shopping and thinking they could have the house next month.

Month to month can be at a premium rate. My son's $450 apt went up $150 while he waited to close on his purchase.

Brad I knew you would have an answer ---raise the rent and the tenant will be in a hurry to leave. The tenant is a lawyer so they know all about closings. Thank you for the suggestion. I want the tenant to move because I have an anxious buyer that wants to move in. --99.62.xxx.xxx
