My friend's son moved into her home with his g/f and 2 infants. He paid 1 month of rent - nothing since. WORSE than that is he has become abusive, and vindictive. He is breaking things and destroying various parts of the property.

I advised her to serve him and the g/f a 14 Day Notice - she did. He acted as expected (digging in his heals that he is never moving and 'he has rights', blah blah blah).

And his destructive and abusive behavior has escalated.

She is counting down the days to file the eviction. Thankfully this is NOT Boston, but it is still MA.

Just wondering - without an Eviction, can she get a Restraining Order on him? Or serve him with a No Trespass notice? Any other ideas that she can do within the boundaries of the law?

I don't know legally, but I thought the laws were a bit different if the landlord lived on site instead of just renting out a place? Maybe a call to a police substation might be in order to just see what they recommend? It's always sad when it comes to that with family. :( --98.175.xxx.xxx

There have been cases on the news that involve someone let into the main part of the home and it's really hard to get rid of them. She should get out of the house. A restraining order often precedes a death since the abuser feels out of control and escalates.

Can you encourage her to leave the home and then pursue the matter? My radar is saying she might have an "accident" if she doesn't get out. Get pets out too. --73.33.xxx.xxx

Today was full of activity after I posted. The daughter of my friend - who also is a resident - filed for, and received, a RO against the son who has been bandying about a string of threats. So, the son is out. But the GF and the children are still occupants of the house. The next court date will be very telling. --98.110.xxx.xx

Diane,

Your friend should change the locks NOW. Locks only keep honest people out but the key indicates who has permission to enter. If he has a key the police will let him in. (until someone shows the police a copy of the RO)

Make copies of the RO for all parties to carry with them at all times. Place one near the front door for handy access. The police want to see it if there is trouble. Don't rely on the police's computer system.

Are these her grandchildren?

My friend is 55 - I don't think she qualifies in MA as I believe the elder abuse laws kick in at age 60. Besides that, she does not live there full time. --98.110.xxx.xx
