Longtime tenant recommended an old friend of hers as new tenant for the almost redone mold lady apartment.

Nurse's aide works nights and son delivers pizza and has SS disability. Here's the problem.

Strike One: Longtime tenant's grand daughter upstairs is asthmatic.

Just found out yesterday that both of them smoke. One hot air heater in the basement makes this arrangement difficult. I have experienced that smokers who say they will smoke outside, do not smoke outside. There is supplemental baseboard heat upstairs but I don't want someone to die of asthma on my watch and it does happen. See this month's Readers Digest.

Strike Two: Nurse's aide has a storage unit and wants to download it into the garage and/or basement. These are items from a house she lost. I just went through this with mold lady. Garage needs to hold a car not plastic boxes. Basement can take on water in a deluge.

Strike Three: Something bothered me about the son. My radar was pinging. Checked predator list and nothing. Checked criminal background and nothing. Just got word that he drives to another state and smuggles in cigarettes for resale. NJ tax is $2.70 per pack. Penalty for him would be fines and the repeated fine is 20K. They could also seize his car. I have only the word of one person, one of his customers, but I need to not be in the line of fire since I know about this issue.

What's your opinion? Am I just avoiding normal LL issues or dodging a bullet.

Thanks for the confirmation. I just hate knowing about the cigarette smuggling and I can't allow it into my property. Every time I met this young man I got a bad feeling that there was a criminal activity but couldn't quite get the message. Now I have it.

I just replied to a Craig's List apartment wanted ad and the size and price is right so I'm waiting to hear from a single man. My radar says he's not perfect and will keep to himself but I'm not getting criminality though he may be on meds. I will have to check this out thoroughly if he contacts me. --73.33.xxx.xxx

The longtime tenant that recommended this nurse aide just admitted that nursey has a giant parrot! Says she forgot until she heard it talking in the background the other day. I don't take parrots since they scream at 4 AM when the sun begins to rise.

I would reject them based on the smoking issue alone.

All my new tenants sign a non smoking clause. But I still have a very heavy smoker that has been with me 13 years. Her smoking and her sons smoking is causing significant problems with the non smoking tenants in the multiplex. Lots of bickering........leaving windows open all day in the winter (i pay for heating), fighting ect........making my life miserable. --70.48.xxx.xx

Whats an ESA? Oh, emotional support animal. She has a dog for that but didn't claim it for that. This is beyond any pet issue. Grandma wanted to put two smokers in a house with her asthmatic granddaughter. There is no excuse for that. Bad decision making. She almost got it done too. I never thought a nurse's aide would smoke and try to move in with an asthma patient with a small baby.

I figured out what this crew was going to do about the smoking and the asthmatic granddaughter. Andrew, above from Ontario, has it right. I would bet they all decided they would open the windows and crank up the heat to prevent the smoke from coming up. I dodged more than a bullet. These minor criminals were going to rob me via the heater.

Actually the granny is kind of a crook. Two years ago a plastic shutter blew off and skidded across the roof of her old car. She wanted me to pay to have it repainted. It just needed buffing. I called my insurance agent and let them deal with her. The next door neighbor got into the act too. He had a dent in his car door that could only have been caused by another car opening the door into it and he tried to get money from me too. Former tenant and I sold him with the building.
