Section 8 (yes...) moved in 4 months ago. A few days after move in they inform us that the sheet vinyl in foyer has a big tear in it. Housing inspected before they moved in. We spent time in the house and there was NO tear in the flooring. We figure they split it when they moved in the sectional sofa (sliding it in). We told them that it was fine when they moved in. They said it wasn,t and so we supplied them with more flooring that they installed. Handyman was at the house recently doing some work (closet wire shelf/pole) came off the wall. Tenant shows handyman carpet in large living room. There are 3 substantial holes in the carpet. Tenant apparently has figured out that if something is ruined, we will replace it. Holes were not there during the Housing inspection. Tenant has contacted Housing about the holes. Wants carpet replaced. What would you do? What would you tell tenant? --24.233.xxx.xx

Housing inspected, and it was fine. No way it "gets holes" on its own, and that is not wear and tear.

Hopefully you have pre-move in photos?

Did you send a bill for the sheet vinyl that they tore?

Next, NEVER trust a tenant to install or repair anything. Always do it send your handyman to do it, even if that handyman is you.

So, what I would do:

Dear tenant,

The holes are due to damage on your part. The carpet was in good condition 4 months ago, and verified in the housing inspection.

The cost to repair/replace the carpet now is $XXXX. Please remit this amount to the manager, ABC Rentals, by October 31 to pay for the damage done by you to the carpet.

Note: Housing may decide the can't live like that. In which case, housing won't pay the share they agreed to pay. At which time, you can evict for non-payment. --131.151.xx.xx

Bill now for the existing damages, only if the amount exceeds the monthly rent value will I consider splitting the amount - sorry but the deposit can only be used after the unit is empty and keys are returned, me thinks you will be in the housing office before November 1st with a copy of the repair estimate to be time stamped so you can request a hearing to pay off the current damages, newer damages start another damage claim... --76.188.xxx.xx

Time for them to go. This is only the beginning of your troubles. Call the caseworker IMMEDIATELY and tell them you will evict if the res does not move out NOW quietly.

At move IN I take 100 photos with a camera date on the photos.

We get what we allow. Don't allow that vinyl damage to go un-billed.

I'm guessing you skipped the 2 Minute In Home Visit prior to final approval. You would have seen they are housebeaters before you let them into your rental.

I had a Section 8 couple with 3 children. The wife was raised by her grand mother and didn't know how to separate laundry, vacuum carpet or wash floors. Within no time at all the adults destroyed the flooring. Instead of calling me for help, they reported me to Housing. This is like 7 months into their tenancy and everything in the apartment was new when they moved in.

The "Housing" department told me that I have to replace the carpet and vinyl flooring or else my tenants don't have to pay rent until it's been re-inspected and the flooring was replaced!

So I contacted a senor Housing Inspector and paid for a separate inspection of the apartment the SAME DAY I was having the flooring replaced.

Lots of pictures!

I had my contracting employee's remove the furniture and place it in my long central hallway. The Flooring company sent two teams. One to rip out and replace the carpeting and another team to install new vinyl over the old kitchen floor.

Then at 3 PM the senor Housing inspector showed up, took pictures and issued me a certificate of compliance -- I had replaced the carpet with over 29 once goods and the kitchen floor was new.

About three weeks later, the Housing Department Case Worker who issued me the violation, "I must replace the flooring or else no rent", showed up. HE FAILED ME! WITHIN THE A COUPLE OF WEEKS THESE TENANTS PUT HOLE AND MADE NEW CARPET LOOK LIKE DISASTER.

I showed the case worker my receipt and pictures of the carpet being changed. He didn't care! He said he wants to see new carpeting. I told him then he should have showed up the day of installation, like his Boss did. I then presented my Certificate of Compliance singed by his boss.

The City charged me $250 for the general inspections and $125 for the senor inspector. I sued the city in small claims court. Before my trial date the city mailed me two checks, refund for the inspection. My case was dismissed. --47.156.xx.xx

I definitely get the appeal of accepting Section 8 tenants. I currently have 1. I think this 1 will be there forever. On the flip side, I have to fight with the city every inspection for stupid stuff that is usually caused by the tenant. I told the inspector one time I was evicting a different tenant and his response was "Well, I hate to hear that. We're losing more and more landlords every year." I told him it wasn't hard to figure out why and it fell on deaf ears. In my area, they are just like the stories above AND they don't pay market rent to boot. It just gets to the point it's not worth it, the cost of aspirin far outweighs the rent received. --98.175.xxx.xxx

There is NO appeal to renting to Sec. 8 tenants. I would not rent to them if I could get acceptable tenants that were not on government assistance. Some are fine and others are unappreciative and cause many problems. --24.233.xxx.xx

Also a lot has to do with how you local office is run. Most seem to be as bad as the tenants.

But at this point you would need to show the carpet was cut and get a statement from the inspector the carpet was in good shape.

Sec 8 will still require you to replace the carpet if you still want them to pay. Here they will not make the tenants pay for damages. That is your job. Handle just like any other tenant.

Up to you to prove the tenant did the damage and collect. Better late then never. Get in take pics. So next time you can prove your damages and sue to collect if tenants dont pay. --73.177.xxx.xx

I take dozens of pictures with close-ups of locks, screens, etc. and have them sign the proof sheet at move in. No arguments in court when you can produce move-in pictures. Any damage must be billed as it happens. They must sign a repayment agreement and stick to it. Take it to housing authority for their records. Some even have a form for this. No more than a few months payback. If they do not pay, take them to small claims court, then take that judgment to the PHA. They can and will lose their voucher then. I have helped them lose their vouchers. Garnished over 4K from one later in addition to loss of her voucher for basically life. Will also prevent her from getting into any other kind of assisted housing anywhere in the country. --40.133.xxx.xxx
