Hello, I was Recently awarded a judgement of $911.00 for Damage done to my property by a former tenant. The issue is she is on Section 8, has 5 kids possibly no job. Is there a way to intercept her tax refund to collect my money. Or Should I just walk away from this? I sued her for excessive pest control treatments for a roach infestation plus she put bread in my vents which costed me a lot of money to get cleaned out. I just think she needs to pay for what she did. --172.56.x.xxx

I have no experience seizing a tax return. Some states allows it, but others don't.

Even if you can't do that, don't just walk away totally. Broke people sometimes "come into" money either from Dear Old Aunt Tilly's estate, getting married, starting a business, or winning the Lottery. I would file with a collection agency. They'll get the judgment to show up on the ex-tenant's credit report, and keep the amount process "active." Somewhere down the road she may want to buy a car or something else that requires credit to be cleaned up, and she may call you to work out a deal.

Contingency collection agencies don't charge you a dime unless they collect. I have had success getting money from some tenants from 8 years ago in this way.

P.S. Another reason I refuse to participate in Sec 8's "guaranteed rent" plan. Yeah, the rent is nice, but as you've seen they could care less when a tenant damages your house. --173.19.xx.xxx

When my tenant moved out my place was infested with roaches. I hired a pest control company who had to treat the place for a month. New tenants moved in and after a week being there, they saw roaches coming from the air vent in the floor. The husband pulls off the vent cover and found bread in the air vent and emailed me pictures. I almost fell out my Chair at work. It was the worst experience ever. --172.56.x.xxx

This is why you need to change your screening process and the type of tenants you rent too. A person receiving government aid has no need to make or keep cash in the bank. From hand to mouth leaves no money to pay anyone for anything.

I had a tenant live in a building I purchased. They were on Section 8. Had a car with no drivers license, no insurance and not propertly registered. They hit another tenants car in the buildings parking lot. So the next day I asked for the "information" for which they provided nothing. Then I served them with a notice to perform or quit. Then towed the car off of my property and started an eviction. Got rid of them and went on to my next tenant, forgetting about any sort of collection -- bead beats never put up, judgement or not.... --47.156.xx.xx

The collection is not so complex, you should be able to visit the finance office of the HUD agency and have each judgement paper time stamped, request a meeting with the case worker and the tenant will be notified to meet with you and the case worker - do not accept time payments that exceed the monthly rental amount, I have heard of some landlords allowing 50bux a month but this damage took a short time to be created and must be resolved quickly (in any tenancy a landlord has - wallet training 101), request the payments be made fedex or whatever your court uses for service besides USPS. --76.188.xxx.xx
