State Specific Question About: PENNSYLVANIA (PA)

I have a tenant since July 25, 2017 on a month-to-month Lease. I want to evict him the cheapest way possible; also I have made plans to be outside the US for 3 months starting Nov.01. How is the best way to proceed. Thanks. --73.79.xxx.xxx

Cant you just ask him to leave. In my state on a month to month i just give the number of days required... Read the lease. Each month it's a new month. No guarantees for another if either party gives notice. Your lease should spell out the terms. Mine lease reads 30 days.. Yours may read 60. No need to evict. That harsh. Read your lease and follow what it says. You may need to give power of Attorney to a family member or trusted friend or management company while you are traveling...? --66.87.xx.xx

30 day notice of non-renewal prior to the beginning of the rental period. If you provide a 30 day notice today and rent is due Nov 1, the lease ends at the end of November not mid. As you will be gone for 3 months you will have trouble doing a walk through after they leave or evicting if they don't. December vacancy is nothing to look forward to, tough to find a qualified applicant, you won't be around to place another tenant and utilities will need to be on in your name for the winter. --96.236.xxx.xxx

Have you given notice that his tenancy is being terminated? If yes, when did the notice say he was supposed to be out? Did that notice given, him the required amount of time?

If yes to all and he has refused to leave, then your next step is LLT court. But if you go that route, he won't be out by the end of October.

If you REALLY want him out before then, you might want to pay him to leave. But WHY do you want him out? Is he paying on time & a good tenant? If so, wouldn't it be worth considering getting a property manager?

Yes they'd charge you money but the place wouldn't sit empty for three months which would cost you more. Plua if it's empty that long, you might very well end up with squatters. --192.168.x.xxx

Philip - first off, don't use your full name on this forum, as a tenant could possibly find your post and make drama about it. Most of us use just first names or a pseudonym, for our own safety.

Second, I agree that in PA, a month-to-month tenancy requires that you give a full calendar month's notice. November 1st, therefore, is not going to happen, as you would have to have all of November, even if notifying today.

I agree that you need to get a property manager and an eviction attorney involved (if the tenant refuses to vacate on 11/30, or is already behind on his rent.) The attorney can also tell you whether or not you have any grounds for eviction or a restraining order if you have been threatened.

If you are in an area with a strong housing investor's association (like the Greater Philadelphia REIA), that would be a great place to get advice and recommendations.
