How many times have you filed eviction on a tenant only to have them pay their rent the exact same day? Just had one of those today. It's happened before, but kind of rare. Curious about everyone's experience with this.

I have had this to happen. Every case so far, I act as if I can't proceed because I filed for non-payment.

At this point they are on payday payment plans, and quickly are again late. False starts on evictions. --72.172.xxx.xx

Yes, it has happened to us. In PA it costs around $140 to file. We will drop the case when rent and filing fee is received. Always better when they pay on time according to agreement. --73.236.xxx.xxx

I had one pay while I was in line to file. I was looking at my phone while waiting and saw the payment notification come through. And I have had several pay within a few days, I think the court costs showing up on their bill gives them a reality check and they decide it is more important to pay the rent than whatever else they were planning to use the money for. --73.102.xxx.xx

I just had a tenant partial-pay, and I know she hasn't received her court papers yet. The problem is, the judge may just let her stay if she manages to come up with some more before the court date. She's got a story and has applied for assistance- so, we will see what happens... --23.30.xx.xxx

Never got that far. Always got paid as soon as I issued the pay or quit. Pretty rare to have to ever issue a second one once the tenant learned I filed for eviction on day 7. (Quickest allowed by law, or I would have filed sooner) --174.216.xx.xxx

Sid,

We've had this. We consider the payment late. We don't feel guilty because they knew eviction was coming. It's not a surprise.

They paid because they got our 3 day text and we stay right on schedule.

If they paid "enough" we simply CONTINUE the case because

- we already paid the fee

- we tell them "If you pay you can stay."

- this is the beginning of the end. About half are evicted the next month.

"Same day" is a 24 hour period. If we file at 9 am sometimes they pay at 5 pm because we already posted the court summons on their door.

Also, my judge says there is a difference between RECIEVED and ACCEPTED. We might hold that payment because it's usually a partial and proceed with eviction.

We screen like crazy but lives change, jobs are cut, factories close, people divorce or pick up a drug or gambling habit, a income earner gets sick or hurt...

Overall, ZERO TOLERANCE on lates has dramatically reduced our evictions. I know that sounds backwards but people DO pay when given a firm deadline.

We have one tenant who we have started eviction proceedings twice -- he always pays everything up before the court date.

We have another one who we have had to file eviction proceedings, but he does not want to go before the judge, so he pays up, including the Court Fees

When we issue new leases, we have a provision in the lease that states we can collect an Administration Fee, in addition to the Court Filing Costs. If they want to pay extra every time, so be it.
