I'm new to this, I have been paying a few people (occasional independent contractors) did understand that I was supposed to fill out forms (?) to IRS. Am I in trouble? Do I do something to make it up now?

What am I supposed to fill out and send in? One of the workers I am on bad terms with. Not sure how he is going to react if I send him stuff now. (Do I have to or just send IRS info. )

Allen,

I use 2 forms:

-Independent Contractor Agreement which protects ME (they declare they are in IC, pay their own taxes, use their own tools, do work for other people not just me, are paid by the workorder not weekly...) Need their SS# and address.

-IRS form 1099. We send this in January if we paid that contractor $600 or more during the previous calendar year. Every IC knows what this is. Uses their SS#.

Sorry, W's right. My IC agreement includes the IRS W-9.

Call or text the IC and ask for his SS#.

The point is, getting his SS (main guy) will never work.

I fired him for stealing a substantial amount of materials.

Not on good terms.

I other guys, (some worked a few years ago) I have a feeling are not going to be too happy that I'm asking for it and filing NOW. --71.192.xxx.xxx

It's not the end of the world if you the send the 1099 without their SS#. The IRS will send you a letter telling you that you to withold a percentage of their pay ( A little over 20%) from any future checks until you get a W2 filled out. It's amazing how quickly they get you the info when they see that it hurts their pay. Have an accountant do the 1099s at the end of the year if you are new at it. --66.189.xx.xxx

OK,..the main guy (about 90% of outgo,,about 33K) was fired. I won't be using him again. Yes i will do ss and 1099s from now but wondering what to do now.

So you hire someone that does a job for say 200. You then have a job that is 300. What do you do, call them when you have a 400 job and say you can't pay them until they hand over their SS#? --71.192.xxx.xxx

I checked with my CPA who does my taxes & he said the requirement to file a 1099 Misc for $600 or more contractor payments was ended about 2 yrs ago. So 2017 tax year I'm not sending out 1099s. --47.156.x.xxx

I had a contractor who would not give me his SS either but he did give me his address. Per my accountant I sent the 1099 to the IRS and IC. The government knows where to find him. I attached a note to the copy for the IRS that they refused to provide the info. Let them deal with it.

The IRS will put them through an audit. Works for me.

Fines for not issuing 1099's can be costly so CYA. --75.181.xxx.xx
