Unlike Pete on the Sept. 12 post, I currently have filed with the courts a Judgement for a Jailed tenant. I spoke with his father,

and he went in and took out the things that he wanted. He doesn't expect his son will be out of jail anytime soon. My question is, since I have a judgement from the court, can I go in after the move out date and remove his things and change the locks without getting an order of eviction?

Unless you visit the tenant in jail & can get him to sign a release, IMO you'll need to do a court eviction.

Why did you allow his father to enter the unit & take some things? Was the father on the rental agreement? --72.93.xxx.xxx

I gave the father a courtesy call to let him know that I had filled a judgement and that eviction was the next step. He said that he would talk to his son and find out what he wanted and then go get it before everthing else was removed. I did not let him in, he has a key. --24.127.xxx.xxx

If the wait in long or you don't want to pay an atty, take a Release of Possession paper to the jail and have the res sign it.
