My tenant moved out after 3 months of trashing the place, and breaking out lots of windows, said they all slammed shut. Supposed to have moved by last week according to judges warrant. Today, because of holiday weekend, Sheriff comes and I take everything of hers outside the house that's left. Apparently she was doing laundry with a washer dryer when i showed up with sheriff, but she was not home. Most of her belongings were already moved. When she returns 3 hours later, everything was outside, including alot of garbage. Also she changed the locks a week before she has to be out, so I went thru a window to get in. She said how much of a slum lord I was and how I took advantage of her cause she needed a place. Then I said to take what she wants, cause I am putting everything at the curb. I was resentful of her destroying the place, although she attempted to clean up before she left compared to the way it looked last week. She leaves to get kids from school. Then I put everything at the curb, including the washer dryer. Scrap metal people take the washer/dryer immediately. She returns later with the police, although I don't think I did anything wrong. Should I reimburse her since I didn't leave her thing near the house. Should I have safe guarded the washer dryer? She didn't take care of my place, but normally I would not put it out immediately. --108.176.xxx.xxx

Are you being charged? If not I guess she should of moved her junk time, eh.

If you didn't, next time I'd have multiple witnesses AND video of all activities related to set out. But if sheriff was there, then I'd say SHE was trespassing.

What do your local laws say about putting tenant's stuff out?

In MA we are required to catalog their "treasures", have it moved by movers, placed into a bonded storage facility & notify tenant of the storage facility's location.

If your state allows the tenant's stuff to be put on the curb, I won't be in any rush to do anything for her. However if you feel bad about it you could always deduct the cost of a Craig's list washing machine from the monies she owes for back rent, court / sheriff costs & damages to the property. --72.93.xxx.xxx

In AL, once you have a Writ of Possession and the Constable supervises the 'put-out', everything placed on the curb is free for anyone (scavengers) to take. --68.63.xxx.xxx

If you were there with the sheriff for a legal eviction the sheriff told you it was junk if he left and let you deal with it still in the unit.Her tough luck.If you are feeling bad about her losing her stuff after destroying your unit you need to either get over it or consider selling the building because maybe this isn't the business for you --72.231.xxx.xxx

We can put stuff at curb with sheriff present or I lock the place up and they have 24 hours to get there stuff before it goes to curb. Get every thing out as fast as you can or they will break in later to get stuff. This all depends on your state's laws. In NV, I cannot put things out on the curb on eviction day. I need to store it, give notice, ....

She didn't say anything to me, but neighbor saw her back there, grab a basketball from the bushes, and took an old wood step ladder of mine, loading it into her minivan. I thought about having her arrested, but I really just want her to go away, and its only worth $20-30 if that is the last I see of her. And Yes the Sheriff was there during the start of the eviction, but told me to take care of putting the stuff out and left.If I shouldn't feel bad, should I feel happy that the scrap people made off with her washing machine? It all comes down to following rules, and you should know them before opening for business, do you need a licensed mover? My big city requires I hire a mover and they basically do everything you did, accross the street in another city I can do the moving myself, another one nearby I can put everything into a storage place and the tenant has 4 months to pay off court before the storage place will allow access unless I sign a waiver (fat chance of that- haha), so it seems like you became a teacher of value for a short period - tenant must follow rules, if everyone did follow rules the housing courthouse would be a badmitton court... --76.188.xxx.xx
