Tenant of 4 years just moved out. Found leaky toilet that has ruined floor. Dripped in the basement (unfinished) on her stuff. Wet stuff was left at move-out. When asked she claimed she didn't know as she never when into the basement. Is she liable for damages?

Bummer.

THIS is why we do a 200 point inspection BEFORE move in and do a walk thru twice a year, CHECKING for leaking toilets among other things.

Small note, My lease is clear: no basement is guaranteed dry. Use it at your own risk.

Thanks for the info. No issue from tenant with the stuff to be removed. Other items also left to be removed on her dime. Foundation buckling is the big issue - always a problem in my area - was fixed one time way back but didn't hold. Good thing I bought it right! --184.179.xx.xx

Mine had bathtub shower curtain outside the tub, the plumber suspects. Every shower turned into a rainstorm in the basement. This was not reported. She and daughter did laundry ten feet from this mess.

I went in to check often but the water had dried by the time I got there in the afternoon. Mold grew this summer and tenant withheld rent then left. I have cleaned it up. I charged her only for tile damage from her two rabbits in the dining area. Plumber made repairs as soon as I found it. I was checking for the reported mold and all of a sudden heard the shower go on and a rainstorm followed. --73.33.xxx.xxx

My lease includes a clause that any costs incurred for damages resulting from a failure to report required repairs is the tenants responsibility.

It seems to be working since I'm getting calls for things they use to ignore.

They had to know. I too, am adding a clause to my lease about requiring tenants to report damages. Brad, I live just outside Wichita, but work and have my properties in Wichita. Most are in Sleepy Hollow/Overlook area. --108.200.xxx.xxx
