Sent former tenants itemized letters and checks for remaining security deposit. Letter to each tenant was sent certified. Got one receipt back and that check was cashed. Have not received other receipt back and that check has not been cashed. It's been almost three weeks since letters were sent and two weeks since first letter was received and check cashed. What do I do? Just wait for receipt to come in?

In NC we are required to hold the funds for 6 months which corresponds to the amount of time until a check becomes stale dated. If at the end of the allotted time it has not been claimed or the check cashed we have to give the funds to the clerk of court.
You need to check what your state requirements are. I would call the courthouse.

Why would split a deposit in OH, it goes with both names on check - they have to join and divide without you helping, I have heard judges talk about how this is not a god idea but have never seen a triple deposit refund on that, other boo-boos yes.. --76.188.xxx.xx |

Tenant Security Deposit Act
Chapter 42-52
LL shall hold the balance of the deposit for a minimum of 6 months...nor may the landlord retain an amount from the security deposit which exceeds his actual damages.
The money doesn't belong to you so you need to treat it just as banks do for unclaimed funds. It goes to the state via the Clerk of Court.
Some boroughs and towns have variations on who to give the unclaimed funds to so you might want to call your local courthouse when the need arises or since it is not a common issue call the NC RE Commission. --75.181.xxx.xx |
